What the SNF Service Agreement Covers

The SNF Service Agreement is a written contract between a skilled nursing facility and a resident, family member, or third‑party payer that defines the scope of nursing, custodial, and ancillary services, payment terms, admission and discharge procedures, and responsibilities of each party. It documents clinical and nonclinical services, consent for treatment, and financial arrangements including rates, insurance billing, and third‑party guarantees. The agreement sets performance expectations, outlines dispute resolution and liability limits, and serves as an enforceable record for regulatory compliance, billing audits, and care coordination.

Why a Clear SNF Service Agreement Matters

A SNF Service Agreement clarifies care responsibilities, payment obligations, and legal protections for residents and facilities. It reduces disputes, supports accurate billing and insurance claims, and documents consent and compliance obligations under healthcare regulations such as HIPAA and applicable state law.

Why a Clear SNF Service Agreement Matters

Who Typically Prepares and Signs This Agreement

Typical parties who use the SNF Service Agreement include facility administrators, discharge planners, residents or their legal representatives, and third‑party payers.

  • Skilled nursing facility administrators managing admissions, care contracts, and billing practices.
  • Residents or durable power of attorney signing for care, consent, and financial responsibility.
  • Insurance companies, Medicare/Medicaid representatives, and private pay guarantors reviewing coverage and payment terms.

Use by interdisciplinary teams ensures the agreement aligns clinical plans, payer requirements, and resident rights before admission and during care transitions.

Representative Roles and Responsibilities

Facility Administrator

Facility Administrator — typically a nursing home director or administrator who negotiates service terms, ensures regulatory compliance, oversees billing and payer contracts, and authorizes final agreement language on behalf of the skilled nursing facility.

Resident Representative

Resident Representative — a resident, family member, or legally appointed representative (e.g., durable power of attorney) who signs to accept care terms, financial responsibilities, advance directives, and dispute resolution provisions on behalf of the resident when authorized.

Essential Information to Include

Full Legal Name: Exact name on government ID
Date of Birth: Use MM/DD/YYYY birthdate format
Insurance Information: Policy number, carrier, group name
Medicare/Medicaid ID: Include CMS number if applicable
Emergency Contact: Name, relation, phone number
Effective Service Date: Start date as MM/DD/YYYY

Common Penalties and Contract Risks

Billing Errors: Retrospective denials, recoupments.
HIPAA Noncompliance: Civil penalties, corrective action.
Breach of Contract: Damages, injunctive relief.
Delayed Payment: Interest, collection actions.
Insurance Denial: Patient liable for charges.
Missing Signatures: Agreement unenforceable in disputes.

Common Preparation Mistakes to Avoid

  • Incomplete payer details cause claim denials and billing delays; verify policy numbers and effective dates before finalizing the agreement.
  • Using informal or ambiguous service descriptions can lead to disputes; specify nursing, therapy, medication administration, and ancillary services clearly.
  • Mismatched names between ID, insurance, and the agreement trigger coverage problems and may require corrective amendments or re-signatures.
  • Omitting dispute resolution or governing law clauses leaves parties unclear on remedies; include jurisdiction and arbitration or venue provisions explicitly.

Core Sections to Include in the Agreement

Main components ensure care expectations, billing clarity, and legal protections; draft each section to reflect clinical responsibilities, payment mechanics, and compliance requirements.

Parties & Recitals

Identify contracting parties with legal names, business addresses, capacity to contract, and recitals describing purpose, resident admission basis, and any third‑party payer involvement to clarify contractual relationships and responsibilities.

Scope of Services

Describe clinical care, nursing levels, therapy services, medication administration, dietary and social services, and measurable service standards including response times and staffing ratios where applicable to avoid ambiguity.

Payment Terms

Specify rates, billing cadence, accepted payers, co‑pay amounts, third‑party guarantor obligations, late fees, and procedures for denied claims or retroactive adjustments to protect facility revenue.

Admission & Discharge

State admission criteria, required assessments, care planning timelines, notice periods for discharge, transfer procedures, and conditions under which a resident may be involuntarily discharged.

Liability & Insurance

Allocate liability limits, indemnities, insurance coverages required of the facility and resident or guarantor, and notice procedures for claims and incidents to manage risk exposure.

Termination & Dispute Resolution

Define termination for cause or convenience, cure periods, notice requirements, governing law, and dispute resolution including mediation or arbitration preferences and venue selection.

Practical Tips for Accurate Completion

Follow these practical practices to reduce disputes, speed billing, and maintain compliance when using SNF Service Agreements.

Verify payer eligibility and coverage
Confirm insurance coverage, effective dates, authorizations, and prior‑authorization requirements before admission. Document payer contact info and billing addresses to prevent denials and ensure proper routing of claims and remittances.
Use explicit, measurable service language
Define services, frequency, staffing expectations, and measurable performance metrics. Attach care plans and clinical assessment schedules as exhibits to reduce later disputes over scope and contractual obligations and billing eligibility.
Document signer identity and authority
Collect proof of authority for agents, record POA or guardianship documents, and record the signer's printed name and title. This minimizes challenges to validity and supports payer audits or legal review.
Secure PHI and maintain audit trails
Encrypt documents in transit and at rest, restrict access, and maintain a complete audit trail with timestamps, IP addresses, and authentication events. For PHI, require a BAA with the eSignature provider to satisfy HIPAA obligations.
