SNORKEL ACTIVITY WAIVER AND SERVICES AGREEMENT

Parties

WHEREAS, Provider is engaged in offering guided snorkeling activities, equipment rental, instruction, and related services for the safe enjoyment of marine environments; and

WHEREAS, Participant desires to engage Provider for the snorkel activity described below and acknowledges that participation involves inherent risks, hazards and exposures that cannot be entirely eliminated; and

NOW, THEREFORE, in consideration of Provider agreeing to provide the snorkel services and Participant paying the required fees, the parties agree as follows:

Scope of Work

Provider will furnish guided snorkeling services, including instruction, supervision, and standard snorkeling equipment. Specifics of the activity (date, time, location, number of participants, and additional services) are described below and form part of this agreement:

Payment Terms

Participant shall pay Provider the fees set forth below in consideration for the services. All amounts are in U.S. dollars.

Failure to make payment when due entitles Provider to suspend services, cancel the booking, and retain any deposit as liquidated damages to the extent permitted by law. Participant remains liable for unpaid fees and costs of collection, including reasonable attorney's fees.

Assumption of Risk, Release and Indemnification

Participant acknowledges that snorkeling and related water activities carry inherent risks including drowning, collisions, marine life interaction, changing weather, equipment failure, slips, and bodily injury. Participant voluntarily assumes all such risks, whether known or unknown.

To the fullest extent permitted by law, Participant releases, waives and discharges Provider, its officers, employees, agents, guides, subcontractors and insurers (collectively "Released Parties") from all claims, liabilities, demands or causes of action, including claims for negligence, arising out of or relating to Participant's participation in the activity. Participant agrees to indemnify and hold harmless the Released Parties from any loss, liability, damage or cost, including reasonable attorneys' fees, arising from Participant's acts or omissions.

Medical Disclosure and Fitness

Participant affirms that Participant is physically fit and capable of participation. Participant must disclose any medical conditions, medications, or limitations that could affect safety.

Equipment and Conduct Acknowledgement

Participant will inspect issued equipment prior to use and notify Provider of any defects. Participant agrees to follow all safety instructions, remain with the group, and comply with Provider's directions. Failure to follow instructions may result in immediate removal from the activity without refund.

Term and Termination

This Agreement commences on the Start Date below and terminates on the End Date below unless earlier terminated in accordance with this section. Either party may terminate for material breach if the breaching party fails to cure within the notice period specified below.

Confidentiality

Each party agrees to maintain confidential any proprietary information of the other party that is disclosed in connection with this Agreement and that is designated as confidential or that by its nature should reasonably be understood to be confidential, except to the extent disclosure is required by law. Confidential information does not include information that is or becomes public through no fault of the receiving party.

Governing Law; Venue

This Agreement shall be governed by and construed in accordance with the laws of the state specified below. Any dispute arising under this Agreement shall be subject to the exclusive jurisdiction of the state and federal courts located in that state.

Severability; Entire Agreement

If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior agreements, understandings and representations, whether written or oral.

Acknowledgement and Certification

Participant certifies that Participant has read this Agreement in full, understands its terms, and is signing freely and voluntarily. Participant acknowledges receipt of any rules, safety guidelines, and equipment instructions provided by Provider.
