What the Snow Removal Service Addendum Is

A Snow Removal Service Addendum is a contract attachment that defines temporary or seasonal snow and ice removal services added to an existing agreement. It clarifies scope, response times, equipment, pricing, access and liability allocation so parties avoid misunderstandings during winter months. The addendum supplements the base contract and becomes enforceable when signed by authorized representatives of both parties, whether executed on paper or electronically under applicable e-signature laws.

Why Add a Snow Removal Service Addendum

An addendum creates clear expectations for timing, performance standards, and payment for winter services, reducing disputes and operational downtime. It protects property owners and contractors by documenting responsibilities such as salt application, plowing priority, weather thresholds, and emergency access.

Why Add a Snow Removal Service Addendum

Who Typically Uses This Addendum

The Snow Removal Service Addendum is used by property managers, commercial landlords, contractors, and municipal maintenance departments to add winter services to existing agreements.

  • Commercial property managers who need defined response and invoicing terms for winter maintenance.
  • General contractors or landscaping firms adding seasonal snow and ice services to service contracts.
  • Municipal or HOA administrators who require priority rules, insurance proof, and public-safety clauses.

Use this addendum when adding discrete snow/ice tasks, adjusting pricing for seasonal service, or recording emergency-call procedures without redrafting the full master agreement.

Authorized Signers and Contact Roles

Property Manager

The property manager signs on behalf of the owner when delegated authority exists; they must ensure the addendum aligns with the master lease and provide contact and billing details.

Contractor Rep

A contractor representative with signature authority signs for the service provider, certifies insurance coverage, and confirms response time commitments and equipment availability.

Essential Contract and Compliance Data

Contract Identifiers: Master agreement ID
Service Address: Full street address
Service Window: Start and end dates
Response Time: Minutes or hours
Insurance Limits: Liability amounts
Signatory Names: Authorized signer titles

Key Legal Risks and Contract Consequences

Breach Liability: Damages exposure
Indemnity Clauses: Third-party claims
Insurance Gaps: Coverage denial
Late Performance: Liquidated damages
Unapproved Subcontracting: Responsibility shift
Tax and Lien Risk: Recording liens

Common Preparation Mistakes to Avoid

  • Using vague thresholds such as 'when necessary' instead of specific accumulation depths or weather triggers leads to disputes over when crews must mobilize.
  • Failing to specify who is responsible for de-icing versus plowing causes duplicated work or gaps in service during freeze-thaw cycles.
  • Omitting proof-of-insurance limits or certificate requirements can leave property owners exposed to third-party claims after a slip-and-fall incident.
  • Not agreeing on priority zones and clearing order can delay access to critical entrances and create liability exposure for emergency egress.

How Execution and Delivery Typically Work

This overview explains the usual flow from drafting to execution and recordkeeping for a signed addendum.

  • Draft Addendum: Draft language and attach as exhibit to base contract.
  • Internal Review: Legal and operations confirm obligations and costs.
  • Signatures: Authorized parties sign physically or electronically.
  • Distribution: Provide copies to operations, billing, and file records.

Core Elements to Include in a Professional Addendum

A robust addendum balances operational detail with contractual clarity so field crews and managers understand obligations without reading the full master contract.

Scope of Work

List exact tasks (plow widths, shoveling locations, salt application) and exclude unrelated services to avoid scope creep and billing disputes.

Response and Priority

State response times by accumulation thresholds and priority sequencing (emergency exits, handicap access, main drives) so crews know deployment order.

Performance Standards

Define acceptable surface conditions post-service—e.g., bare pavement or treated surface—and measurement method for acceptance testing.

Equipment and Staffing

Specify required equipment types and minimum crew levels to meet response commitments, and note substitution rules for emergencies.

Pricing and Billing

State fixed seasonal fees, per-event charges, or time-and-materials rates plus invoicing frequency, late fees, and dispute resolution timelines.

Insurance and Indemnity

Require contractor liability and workers’ compensation coverage, certificate naming the owner as additional insured, and standard indemnity language for claims.

Practical Tips for Clear, Enforceable Addenda

Adopt plain-language terms, measurable triggers, and explicit invoicing rules to reduce interpretation disputes and speed field execution.

Use measurable triggers not subjective terms
Specify accumulation depth in inches, temperature thresholds, or advisory triggers so both parties agree when services commence.
Document access and parking rules
Clarify areas where equipment may operate and outline tenant or owner responsibilities to remove vehicles before plowing.
Include emergency and holiday provisions
Define response exceptions for declared emergencies and holiday scheduling to set proper expectations during peak events.
Keep invoicing consistent with service logs
Require daily service logs, signed work orders, or GPS routes to support invoices and speed resolution of disputes.

Timing and Processing Expectations

Key dates and processing expectations ensure services are scheduled and paid on time throughout the winter season.
