What the Solar Energy Disclosure Form Is and When It Applies

The Solar Energy Disclosure Form is a standardized document used in U.S. real estate and solar transactions to report material facts about photovoltaic systems and related obligations. Typical disclosures include system capacity, ownership or lease status, contract terms, warranty coverage, incentives and rebates, permit and lien status, and maintenance responsibilities. The form helps buyers, lenders, and regulators understand risks tied to installed equipment and supports compliance with state property disclosure laws and financing due diligence.

Why a Clear Solar Energy Disclosure Matters

A properly completed Solar Energy Disclosure Form clarifies system condition, contractual responsibilities, and incentive status, reducing transaction risk and supporting informed decisions by buyers, lenders, and regulators while helping sellers meet state disclosure obligations.

Why a Clear Solar Energy Disclosure Matters

Who Commonly Prepares and Receives This Form

Professionals and parties who commonly interact with Solar Energy Disclosure Forms include property sellers, buyers, solar installers, lenders, and listing agents.

  • Home sellers and listing agents disclosing installed solar systems and related agreements to prospective buyers.
  • Buyers and mortgage underwriters assessing system condition, ownership, and impact on valuation or loan underwriting.
  • Solar developers, installers, and lessors documenting warranties, maintenance plans, and lease or PPA terms.

Local permitting authorities and utility reviewers also rely on disclosures for interconnection, incentive eligibility, and permitting checks.

Primary Roles Involved

Seller

Individuals or entities transferring property with solar equipment must disclose system ownership, outstanding leases or PPAs, recent performance data, warranty status, and any liens or permits. Accurate seller disclosures limit post-closing disputes and may be required by state property disclosure statutes.

Buyer / Lender

Buyers and lenders review disclosures to verify system size, ownership rights, lease obligations, and incentive transfers. Lenders assess encumbrances and warranty coverage to determine financing eligibility; missing or inaccurate disclosures can delay closing or trigger underwriting exceptions.
