What a Solar Panel Removal Agreement Covers

A Solar Panel Removal Agreement is a written contract that documents the terms for dismantling and removing photovoltaic equipment from a property. It sets responsibilities for the owner and contractor, schedules work, allocates costs, and addresses disposal, salvage, and site restoration. The agreement commonly includes insurance, indemnity, permits, and utility disconnect procedures. When executed properly, it reduces disputes over equipment ownership, hazard mitigation, and permitting. Electronic execution under the ESIGN Act and state UETA rules is generally acceptable where no statutory exception applies, allowing efficient remote completion and secure recordkeeping.

Why a Formal Agreement Matters for Removal Projects

A clear removal agreement defines scope, risk allocation, and payment terms so parties avoid later disputes. It protects property condition, clarifies permit responsibilities, and documents insurance and indemnity obligations in case of damage or injury.

Why a Formal Agreement Matters for Removal Projects

Who Typically Uses a Solar Panel Removal Agreement

The agreement is used by multiple stakeholders involved in decommissioning solar arrays.

  • Homeowners and property owners requiring formal scope, insurance proof, and cleanup assurances.
  • Solar contractors and installers documenting work scope, salvage rights, and warranty impacts.
  • Property managers, utilities, and developers coordinating permits, disconnects, and scheduling.

Core Elements to Include in the Agreement

A professional agreement balances operational detail with legal protections so work, costs, and liabilities are unambiguous.

Scope of Work

Describe removal tasks, component inventory, site restoration standards, and whether modules, racking, or inverters are removed or left in place.

Schedule

Specify start and completion dates, work hours, weather allowances, and milestones for permits, utility disconnects, and inspections.

Payment Terms

State total price, payment schedule, retainage, invoicing requirements, and remedies for late payment or nonperformance.

Permits & Utilities

Allocate responsibility for obtaining permits, arranging utility disconnection/reconnection, and complying with local code or landfill rules.

Insurance & Indemnity

Require contractor insurance limits, certificate naming the owner as additional insured, and mutual indemnification for negligence or breach.

Salvage & Disposal

Address ownership of removed materials, salvage rights, recycling obligations, hazardous waste handling, and certifications of proper disposal.

Step-by-Step: Completing the Agreement

Follow this sequence to create a usable, enforceable removal agreement and minimize delays.

  • 01
Draft Scope: Write a detailed scope of work.
  • 02
Allocate Responsibilities: Assign permits, utility contact, and disposal duties.
  • 03
Confirm Insurance: Verify certificates and coverage limits.
  • 04
Execute Signatures: Have authorized representatives sign and date.

Where to Send and File After Signing

  • Owner Records: Retain signed copy with property documents.
  • Contractor Files: Store for warranty and insurance proofs.
  • Permitting Agency: Submit required documents with permit closeout.
  • Utility Company: Provide disconnect/reconnect confirmation when required.

Digital Signing and File Format Considerations

  • File Formats: PDF and DOCX accepted.
  • Integrations: Supports CRM and cloud storage.
  • Security: TLS and AES encryption.

Typical Timelines and Scheduling Expectations

Timeframes vary with permit cycles, utility coordination, and contractor availability; include realistic buffers.

Permit Submission Window:

Allow 2–6 weeks for local permit review.

Utility Disconnect Notice:

Schedule 7–21 days for utility coordination.

Project Start Date:

Agree on a firm start with weather contingencies.

Completion Target:

Set a completion date plus inspection timeframe.

Document Retention Trigger:

Retention clock starts on effective date or final invoice.

Common Mistakes to Avoid When Preparing the Agreement

  • Using vague scope language that omits internal wiring or roof restoration and leads to scope disputes and extra charges.
  • Failing to assign permit responsibility, which can delay work and expose owner to municipal fines or stop-work orders.
  • Not confirming insurance limits or additional insured status, leaving property owners exposed to contractor liability gaps.
  • Overlooking salvage rights and disposal instructions, resulting in disagreement over recovered modules and environmental compliance costs.

Risks and Potential Consequences of an Incomplete Agreement

Contract Breach: Damages and litigation exposure
Permit Violations: Fines and stop-work orders
Property Damage: Repair costs and liability
Environmental Penalties: Hazardous waste fines
Insurance Denial: Coverage gaps for claims
Assignment Disputes: Unclear ownership of removed materials
