What the Solar PV System Agreement Covers

A Solar PV System Agreement is a legally binding contract that sets the terms for design, installation, ownership, performance, payment, warranties, permitting, and operation of a photovoltaic (PV) system at a specified site. It documents parties (owner, installer, financier), system specifications (capacity, equipment list), schedule, inspection and commissioning criteria, and transfer of title or incentives. The agreement typically addresses interconnection with the utility, required permits, maintenance obligations, and remedies for underperformance or default, and is used for residential and commercial installations.

Why a Clear Solar PV System Agreement Matters

A precise agreement reduces dispute risk, clarifies payment and warranty obligations, and speeds permitting and interconnection. It protects property owners, contractors, and lenders by documenting responsibilities and timelines while supporting incentive and tax-credit claims.

Why a Clear Solar PV System Agreement Matters

Who Typically Prepares and Signs This Agreement

The Solar PV System Agreement is used by parties involved in design, installation, financing, and property ownership.

  • Property owners and homeowners association representatives responsible for site access and long-term obligations.
  • Solar contractors and subcontractors who deliver design, equipment, installation, and commissioning.
  • Lenders, leasing companies, or third-party owners providing financing or entering power purchase arrangements.

Each signer should have authority to commit funds, grant access for installation, or accept long-term maintenance obligations.

Core Sections to Include in a Professional Solar PV System Agreement

A well-drafted agreement groups contractual obligations into discrete sections so each party’s duties and remedies are easy to find and enforce.

Parties and Definitions

Identifies installer, owner, site, and defined terms; sets contact and notice addresses for formal communications.

Scope of Work

Describes equipment, system capacity (kW), mounting type, and site-specific design criteria, including any third-party products.

Schedule and Milestones

Establishes permit filing, inspection windows, commissioning date, and remedies for missed milestones or delays.

Payment and Security

Details pricing, deposit schedule, retainage, mechanics lien waivers, escrow, financing terms, and default remedies.

Warranties and Performance

Specifies equipment and workmanship warranties, production guarantees, measurement method, and cure processes for shortfalls.

Permits and Interconnection

Allocates responsibility for permits, interconnection applications, net metering, and compliance with utility requirements.

Step-by-Step: Completing the Solar PV System Agreement

Follow these sequential steps to prepare, verify, and finalize the agreement for permitting, financing, and installation.

  • 01
    1. Gather Documents: Collect site plans, utility bill, title info, and equipment specs.
  • 02
    2. Populate Parties: Fill owner, installer, lender details and contact information accurately.
  • 03
    3. Attach Permits: Upload permit applications, interconnection forms, and structural calculations as exhibits.
  • 04
    4. Sign and Deliver: Execute signatures, notarize if required, and distribute signed copies to stakeholders.

How to Configure an Online Signing Workflow

Set up a digital workflow that matches sign order, authentication level, and required attachments for permitting or lender review.

Field Configuration
Signers Define signer roles and execution order; include lender or third-party owner if applicable.
Authentication Choose email or SMS code for standard signers; KBA or ID verification for high-assurance needs.
Notifications Enable reminders and completion notifications to installer, owner, and lender.
Attachments Require uploads for permits, equipment cut sheets, proof of insurance, and building approvals.

Where to Send or File the Executed Agreement

Deliver signed copies to parties and record or file with agencies as required to activate permits, financing, or incentives.

  • Local Building Department: Submit executed agreement with permit application and structural documents for plan review.
  • Utility Interconnection: Provide signed interconnection agreement to the utility for net metering and final approval.
  • Lender or Lessors: Send final signed agreement and exhibits to the financing institution for loan or lease activation.
  • Owner and Installer: Each party retains a signed PDF copy for warranty, maintenance, and dispute resolution.

Digital Signing and Technical Requirements

Use a secure e-signature platform that supports audit trails, file attachments, and required integrations for permitting and financing.

  • File Formats: PDF and Word DOCX support for permits and attachments.
  • Integrations: Salesforce, NetSuite, Google Workspace, MS 365 integrations available.
  • Authentication Levels: Email, SMS, KBA, or advanced signer authentication per workflow needs.

Essential Security and Compliance Controls

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Captures timestamps, IP, and action history
BAA Support: HIPAA BAA available where required
Regulatory Standards: ESIGN and UETA compliant
Authentication: Supports SMS, KBA, and advanced methods
Access Controls: Role-based permissions and SSO

Common Mistakes to Avoid When Preparing the Agreement

  • Using informal or inconsistent owner names that differ from title documents, which can block interconnection or financing approvals.
  • Failing to attach required permit drawings or structural calculations, delaying plan review and inspections by weeks.
  • Omitting lender or lien waiver clauses when progress payments are made, creating mechanics lien exposure for property owners.
  • Relying on unsigned or initial-only acknowledgements where full signatures and dates are required for enforceability.

Key Risks and Potential Penalties for Incorrect or Missing Information

Permit Denial: Missing documents can cause plan rejection and refile fees
Financial Penalties: Municipal fines or reinspection fees may apply
Void Warranty: Improper installation or unsigned waivers can void manufacturer warranty
Mechanic's Lien: Unsecured payments can expose property to lien claims
Tax Consequences: Incorrect incentive filings may trigger clawbacks or adjustments
Safety Liability: Noncompliant installations increase legal and insurance exposure

Typical Timelines and Deadlines to Track

Timely filings and inspections keep installation on schedule; some deadlines also affect incentive eligibility and tax treatment.

Permit Submission:

Submit with full exhibits before construction; local plan-review times vary from 7 to 45 days.

Inspection Scheduling:

Schedule rough and final inspections promptly; delays can postpone commissioning.

Utility Interconnection:

Submit interconnection paperwork early; utility review timelines differ by provider and region.

Tax Filing:

Claim credits on your federal return by Form 1040 due April 15 (or filed extension).

Warranty Start:

Warranty periods typically begin on commissioning or final acceptance date.
