What the Solar PV System Installation Agreement Covers

A Solar PV System Installation Agreement is a written contract that defines the scope, schedule, payment terms, warranties, and responsibilities between a property owner and a solar installer for design, permitting, procurement, installation, and commissioning of a photovoltaic system. It documents the equipment to be supplied, performance expectations, inspection and interconnection steps, and who is responsible for permits and utility coordination. The agreement also addresses insurance, indemnity, change orders, and remedies for delays or defects, creating a clear, enforceable record of the parties’ commitments.

Why a Formal Installation Agreement Matters

A written installation agreement reduces ambiguity about responsibilities, limits disputes over performance or payments, and preserves evidence needed for permitting, incentives, and warranty claims.

Why a Formal Installation Agreement Matters

Typical parties involved

Common participants include the property owner, licensed solar contractor, subcontractors, equipment suppliers, and financing or leasing entities.

  • Residential owners who want rooftop or ground-mounted PV systems and need formal terms for performance, schedule, and warranty.
  • Commercial property owners and facility managers deploying larger arrays who require detailed payment milestones and liability allocations.
  • Solar contractors and EPC firms who use standardized agreements to manage scope, deliverables, and subcontractor obligations.

Each party should confirm authority to sign, licensing, and insurance coverage before execution to avoid invalid or unenforceable commitments.

Step-by-step: completing and executing the agreement

Follow a clear sequence from review through signature to reduce errors and ensure regulatory compliance.

  • 01
Review Parties: Confirm legal names and authority to sign.
  • 02
Confirm Scope: Verify equipment, site work, and interconnection steps.
  • 03
Agree Terms: Negotiate payment, schedule, and warranty milestones.
  • 04
Sign and Record: Execute signatures and retain the executed agreement for permits and financing.

Typical workflow from proposal to commissioning

A predictable workflow helps coordinate permits, utility interconnection, inspections, and final commissioning.

  • Proposal: Installer provides scope, price, and schedule.
  • Contracting: Parties finalize and sign the installation agreement.
  • Permitting: Installer submits plans and obtains building/utility permits.
  • Commissioning: System tested, inspected, and interconnected to the grid.

Core clauses to include in every Solar PV System Installation Agreement

A comprehensive agreement includes operational, safety, financial, and legal protections so both parties understand expectations and remedies.

Scope of Work

Detailed description of equipment, mounting, electrical work, site access, and whether upgrades to panels, meters, or service are included. Attach equipment spec sheets and single-line diagrams as exhibits.

Schedule & Milestones

Firm dates for mobilization, permit submission, inspections, interconnection, and final acceptance. Include liquidated damages for missed critical milestones if negotiated.

Payment & Security

Payment schedule tied to milestones, retention amounts, acceptable payment methods, and any performance bonds or letters of credit to secure completion.

Warranties

Explicit manufacturer and installer warranty terms, coverage periods, and procedures for making warranty claims and assigning manufacturer warranties to the owner.

Permits & Interconnection

Who is responsible for design submissions, permit fees, and utility interconnection paperwork. Clarify handling of upgrade costs and inspection failures.

Liability & Insurance

Indemnity allocation, required insurance types and limits, and procedures for handling damage, personal injury, and third-party claims during construction and operation.

Information to verify for compliance and security

Contractor License: Confirm current license status
Insurance Coverage: General liability and workers' comp
Equipment Specs: Model, serial number, and efficiency
Permit Numbers: Building and electrical permit IDs
Interconnection: Utility application and approval
Payment Records: Invoices and lien waivers

Common legal and financial risks

Delay Damages: Liquidated damages or lost incentives
Lien Risk: Contractor liens for unpaid work
Permit Denial: Costs of redesign or re-submission
Warranty Gaps: Unassignable manufacturer warranties
Insurance Shortfall: Insufficient coverage for claims
Data Security: Unauthorized access to contract records

Frequent pitfalls when preparing the agreement

  • Vague scope descriptions that omit mounting details and site-specific electrical upgrades, causing later change orders and disputes.
  • Missing permit or interconnection responsibilities leading to delays and unexpected cost allocation between owner and installer.
  • Unclear warranty transfer language that prevents the property owner from asserting manufacturer claims after installation.
  • Failure to confirm contractor license, insurance limits, or lien waiver procedures before making progress payments.
