SPECIAL EDUCATION PARA AGREEMENT

Parties

This Agreement is entered into on:

Recitals

WHEREAS, the School District requires the services of a paraprofessional to provide instructional and behavior support in accordance with individualized education programs and applicable laws and regulations; and

WHEREAS, the Paraeducator represents that the Paraeducator possesses the necessary qualifications, clearances, and training to provide services to students with disabilities and agrees to perform such services under the terms of this Agreement; and

WHEREAS, the parties desire to set forth the duties, compensation, confidentiality obligations, and other terms governing the Paraeducator's provision of services.

Scope of Work

Typical duties include but are not limited to: implementing IEP accommodations, providing one-on-one or small group instructional support, behavior intervention as directed by the student’s behavior plan, data collection and progress reporting to supervising teacher, assistance with personal care only as authorized in the IEP, and maintaining a professional classroom environment.

Payment Terms

Invoices, if required, must itemize hours by date and student or classroom assignment and be submitted to the payroll or accounts payable office within 30 days of performance. The School District shall pay approved invoices within the payment schedule specified above.

Term and Termination

This Agreement commences on and continues until unless earlier terminated as provided herein.

Either party may terminate this Agreement for convenience upon written notice delivered at least days prior to the effective termination date. The School District may also terminate immediately for cause, including but not limited to violation of student safety rules, failure to maintain required clearances, breach of confidentiality, or gross misconduct.

Confidentiality and Student Information

The Paraeducator shall safeguard the confidentiality of all student records and personally identifiable information. The Paraeducator shall comply with all state and federal laws and local board policies governing the privacy of student education records and shall not disclose any such information except as authorized by the School District or required by law. Unauthorized disclosure constitutes a material breach of this Agreement.

Background Checks, Training and Compliance

The Paraeducator must maintain all required background clearances, health screenings, and training certifications. Continued performance under this Agreement is conditioned upon satisfactory clearance results and completion of mandatory training (including behavior supports, medication administration if applicable, and student-specific protocols). The Paraeducator shall immediately notify the School District of any change in clearance status.

Supervision, Evaluation and Materials

The Paraeducator shall perform duties under the supervision of the assigned licensed teacher or district supervisor. The School District reserves the right to evaluate performance and require remediation. The School District will provide access to materials and reasonable accommodations required to execute assigned duties; specialized personal equipment remains the responsibility of the Paraeducator unless otherwise agreed in writing.

Indemnification and Liability

Each party shall be responsible for claims arising from its own negligence or willful misconduct. The Paraeducator shall comply with all School District policies and applicable laws; failure to do so may void indemnification rights and is grounds for termination.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of without regard to its conflicts of law principles.

Entire Agreement

This Agreement, including any attached exhibits and any referenced IEPs incorporated by reference, constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior agreements, understandings, negotiations and discussions, whether oral or written. Any amendment must be in writing and signed by authorized representatives of both parties.

By signing below, the Paraeducator affirms that all information provided to the School District is true and complete, that the Paraeducator has reviewed applicable IEPs for assigned students as required, and that the Paraeducator understands and agrees to abide by the duties and obligations set forth in this Agreement.
