Recitals

WHEREAS, Organization operates and conducts the sports program identified above and provides coaching, training, practice and competitive events to registered participants; and

WHEREAS, Participant (or Participant's parent/legal guardian if Participant is a minor) desires to enroll in and participate in the program and acknowledges the inherent risks associated with athletic activities; and

WHEREAS, the parties wish to set forth the scope of services, payment terms, risk acknowledgements and other terms governing Participant's participation.

Scope of Services

Acknowledgement of Risk and Release

Participant acknowledges and understands that participation in sports involves physical exertion, contact, and the risk of injury including serious injury or death. Participant voluntarily assumes all risks, known and unknown, arising from participation and agrees that Organization, its owners, operators, coaches, volunteers and agents shall not be liable for injury or loss except to the extent caused by Organization's gross negligence or willful misconduct.

Participant further agrees to indemnify and hold harmless Organization from all claims, demands, suits, losses, damages, costs and expenses (including reasonable attorneys' fees) arising from Participant's participation, except where caused by Organization's gross negligence or willful misconduct.

I acknowledge the risks described above and accept responsibility for my participation.

I waive any right to pursue claims against Organization except as limited by law for gross negligence or willful misconduct.

Medical Information & Emergency Consent

Consent to Emergency Treatment: I authorize Organization and its representatives to obtain emergency medical treatment for Participant if necessary, and I agree to be responsible for related costs.

Photographs and Media Release: I consent to the use of photographs, video, and other media featuring Participant for promotional, training, educational or other organizational purposes without compensation to me.

Payment Terms

Failure to make timely payments as set forth in the Payment Schedule may result in suspension from program activities, forfeiture of fees, and collection action. Organization may retain records of unpaid sums and recover reasonable collection and attorney fees to the extent permitted by law.

Organization may terminate Participant's enrollment immediately for violations of rules, failure to pay fees, or conduct presenting a safety risk. Participant may withdraw upon providing the Notice Period above; refunds, if any, will be handled in accordance with Organization's refund policy as set out in the Payment Schedule.

Confidentiality

The parties acknowledge that during the course of participation certain non-public information may be disclosed. Each party shall maintain the confidentiality of such information and shall not disclose confidential information to third parties except as required by law or with prior written consent. Confidential information does not include information that (i) is or becomes generally known to the public through no breach of this provision, (ii) is rightfully received from a third party without restriction, or (iii) was independently developed without access to confidential information.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of , without regard to its conflicts of law principles.

Entire Agreement

This document constitutes the entire agreement between Organization and Participant with respect to Participant's enrollment and supersedes all prior and contemporaneous agreements, representations, and understandings. Any amendment must be in writing and signed by both parties.

Severability: If any provision of this Agreement is held invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.
