I acknowledge that participation in the Activity involves inherent risks, including but not limited to serious bodily injury, permanent disability, or death, and damage to or loss of personal property. I expressly assume all risks arising from participation in the Activity, whether known or unknown, foreseeable or unforeseeable, and waive any right to assert that the Organizer was negligent in failing to eliminate such risks except to the extent caused by the Organizer’s willful misconduct.

RELEASE AND WAIVER

In consideration of being permitted to participate in the Activity, I, on behalf of myself, my heirs, assigns and personal representatives, hereby release, waive, discharge and covenant not to sue the Organizer, its officers, directors, employees, agents, volunteers and affiliates (collectively, "Releasees") from any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs and expenses (including attorneys' fees) arising out of or related to my participation in the Activity, whether caused by the negligence of the Releasees or otherwise, to the fullest extent permitted by law.

INDEMNIFICATION

I agree to indemnify, defend and hold harmless the Releasees from and against any and all claims, losses, damages, liabilities and expenses (including reasonable attorneys' fees) arising from or related to my acts or omissions in connection with the Activity, including claims by third parties.

MEDICAL AUTHORIZATION

I authorize the Releasees to obtain emergency medical treatment for me (or my child) if necessary and agree to be responsible for all costs and expenses incurred. I represent that I have disclosed all known medical conditions that may affect safe participation.

MEDIA RELEASE

I consent to the use of photographs, video, audio or other recordings of my participation in the Activity by the Organizer for promotional, educational, or other lawful purposes without payment or other consideration. If I do not consent, I must initial below.

This Release shall be governed by and construed in accordance with the laws of the state in which the Activity is conducted without regard to conflict of law principles. This Release constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior agreements, oral or written.
