What the Sports Facility Use Agreement Is and When It Applies

A Sports Facility Use Agreement is a written contract that sets terms for use of athletic fields, gyms, courts, or other recreation facilities. It defines permitted activities, hours of use, fees, facility responsibilities, damage and repair allocation, insurance and indemnity obligations, and procedures for cancellations or rescheduling. The agreement helps facility owners manage risk, document expectations for users and groups, and provide a basis for enforcement if damage or injuries occur. It is commonly used by municipalities, schools, clubs, private venues, and tournament organizers.

Why a Clear Sports Facility Use Agreement Matters

A well-drafted agreement reduces liability, clarifies payment and scheduling, and documents insurance and safety responsibilities; it also establishes remedies for damage or cancellations and supports enforceability under the ESIGN Act and applicable state law (15 U.S.C. ch. 96).

Why a Clear Sports Facility Use Agreement Matters

Common users and stakeholders for the agreement

The Sports Facility Use Agreement is used by organizations that own or operate athletic space and by external users who reserve time or space.

  • Municipal parks departments, which manage public schedules and liability insurance for community programs.
  • Schools and athletic departments, which coordinate interscholastic events, facility maintenance, and student safety requirements.
  • Private clubs, leagues, and tournament organizers that need clear payment, cancellation, and damage provisions.

Tailor signatory roles and insurance requirements to the type of user to reduce disputes and align risk allocation.

Core clauses every professional agreement should include

Include clear operational, financial, and liability terms so both owners and users understand obligations and remedies.

Common mistakes to avoid when preparing agreements

  • Using inconsistent date/time formats or failing to state time zone, which causes confusion for multi-venue or out-of-area users.
  • Not documenting cancellation and refund rules clearly, producing disagreements after weather cancellations or event postponements.
