SPORTS SAFETY AGREEMENT

Parties

WHEREAS

WHEREAS, Organization Name is engaged in the operation and administration of organized sports activities and training intended to promote physical fitness and athletic skills, and conducts such activities subject to established safety protocols; and

WHEREAS, Participant desires to participate in the sports programs, practices, competitions, and related events (collectively, the Activities) organized by Organization and acknowledges that participation involves inherent risks, including risk of bodily injury; and

WHEREAS, the parties wish to set forth safety obligations, payment responsibilities, and mutual covenants governing Participant’s participation in the Activities.

Scope of Work

Organization will provide supervision, coaching, equipment checks, and on-site first aid as described below. Participant will comply with all safety instructions and rules established by Organization.

Safety Protocols & Acknowledgements

Participant acknowledges receipt of and agrees to comply with Organization’s safety protocols including equipment requirements, emergency procedures, and concussion management practices. Failure to comply may result in suspension or removal from Activities.

Participant acknowledges equipment requirements (helmets, pads, footwear) and represents that required equipment will be provided and maintained in safe condition.

Participant acknowledges concussion policy, will immediately report symptoms, and will follow return-to-play clearance procedures.

Participant warrants they have obtained any required medical clearance to participate in the Activities.

Payment Terms

All fees due under this Agreement are non-refundable except as expressly set forth in writing. Organization may suspend Participant’s participation for non-payment until payment is made in full.

Term and Termination

This Agreement commences on Start Date: and terminates on End Date: unless earlier terminated as provided herein.

Organization may terminate immediately for cause where Participant materially breaches safety rules or behaves in a manner that endangers others.

Assumption of Risk; Waiver; Indemnification

Participant understands and voluntarily assumes all risks associated with participation in the Activities, including but not limited to collision, falls, contact with other participants, and unexpected equipment failure. Participant releases and forever discharges Organization, its officers, directors, employees, coaches, volunteers, and agents from any liability for injury, death, loss, or damage arising out of participation, except for liability arising from Organization’s gross negligence or willful misconduct.

Participant agrees to indemnify, defend, and hold harmless Organization from and against any claims, demands, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from Participant’s negligence or breach of this Agreement.

Confidentiality

Each party shall maintain the confidentiality of non-public information obtained in connection with the Activities and shall not disclose such information except as required by law or with the other party’s prior written consent. Confidential information does not include information that is or becomes public through no breach of this Agreement.

Governing Law; Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of without regard to conflict of law principles. The parties agree that any dispute arising under this Agreement shall be resolved through binding arbitration if mutually agreed; otherwise, venue for any action shall lie in the courts of the foregoing state.

Entire Agreement; Amendment; Severability

This Agreement, including any attachments or waivers executed contemporaneously, constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior negotiations and understandings. Any amendment must be in writing and signed by both parties. If any provision is held invalid, the remainder shall continue in full force and effect.
