Sports Team Agreement

This Sports Team Agreement (the Agreement) is entered into as of Effective Date: by and between Team Name: with principal address: , represented by Representative Name: , Title: (hereinafter "Team"), and Player Name: , residing at , Date of Birth: (hereinafter "Player").

Recitals

WHEREAS, Team organizes, fields, and manages a sports team and related activities, including practices, games, exhibitions, and promotional events; and

WHEREAS, Player has experience, skill, and eligibility to participate as a member of Team's roster and agrees to perform the duties and comply with the policies described in this Agreement; and

WHEREAS, the parties desire to set forth their respective rights and obligations with respect to Player's participation on Team for the Term defined below.

NOW, THEREFORE, in consideration of the mutual covenants contained herein and other good and valuable consideration, the receipt and adequacy of which are acknowledged, the parties agree as follows:

1. Definitions

1.1 "Season" means the period commencing on Season Start Date: and ending on Season End Date: , including any postseason play that arises from that period.

2. Term

2.1 The term of this Agreement (the Term) shall commence on the Effective Date and continue through the Season End Date unless earlier terminated in accordance with Section 11 below. The Team may extend the Term by written amendment signed by both parties.

3. Player Obligations

3.1 Player shall: (a) attend and participate in practices, games and team meetings as scheduled by Team; (b) maintain physical fitness and conditioning; (c) comply with Team policies, codes of conduct and instructions of coaches and Team management; and (d) present themselves for selection, substitution, and travel in a timely manner.

3.2 Player shall not engage in activities that jeopardize Player's ability to perform, including hazardous recreational activities, illegal conduct, or use of prohibited substances. Violation may result in discipline up to and including termination for cause.

4. Team Obligations

4.1 Team shall provide Player reasonable opportunity to participate, subject to selection, merit, health and compliance with Team rules. Team shall provide coaching, scheduling, and access to team facilities as available.

5. Compensation and Benefits

6. Equipment and Uniforms

6.1 Team shall provide standard uniforms and team-issued equipment as set forth in the Team equipment policy. Player is responsible for proper care and return of Team property upon request. Failure to return issued equipment may result in set-off from compensation and/or civil recovery.

7. Medical, Insurance and Injury

7.1 Player acknowledges and accepts the inherent risks of athletic participation. Player shall promptly disclose any medical condition that may affect participation and shall comply with medical advice provided by Team-approved medical personnel.

I confirm Player shall maintain health/accident insurance while participating.

7.2 Team may require medical clearance prior to return to full participation following injury. Team shall not be liable for exacerbation of pre-existing conditions of which Player did not disclose in writing prior to participation.

8. Conduct, Discipline and Policies

8.1 Team policies, including codes of conduct, anti-doping rules, and disciplinary procedures, are incorporated by reference and govern Player conduct. Player consents to reasonable discipline, including suspension or termination, for violations or conduct detrimental to the Team.

9. Media, Publicity and Intellectual Property

9.1 Player grants Team a non-exclusive, royalty-free license to use Player's name, image, voice and likeness in connection with Team promotions, broadcasts, and merchandising during the Term. Such use shall be limited to activities reasonably related to Team operations.

10. Indemnification and Liability

10.1 Each party shall indemnify, defend and hold harmless the other party, its officers, directors, employees and agents from and against any third-party claims, liabilities, losses or expenses (including reasonable attorneys' fees) arising from the indemnifying party's breach of this Agreement, willful misconduct, or negligent acts or omissions.

10.2 Except for willful misconduct or gross negligence, neither party shall be liable for consequential, punitive or incidental damages arising out of performance under this Agreement.

11. Termination

11.1 This Agreement may be terminated by Team for cause upon written notice for material breach, including failure to attend scheduled obligations, violation of Team rules, or conduct detrimental to Team. Player may terminate for material breach by Team if Team fails to cure a breach within 30 days after written notice.

12. Notices

12.1 All notices required under this Agreement must be in writing and delivered by personal delivery, certified mail (return receipt requested), or nationally recognized overnight courier to the addresses set forth below or to such other address as either party designates by written notice pursuant to this Section.

13. Governing Law

13.1 This Agreement shall be governed by and construed in accordance with the laws of the State identified below, without regard to conflict of law principles.

14. Entire Agreement; Severability

14.1 This Agreement, together with any attachments and written policies expressly incorporated herein, constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior agreements and understandings, whether written or oral.

14.2 If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall remain in full force and effect and the parties shall negotiate an enforceable substitute provision that most nearly effects the parties' intent.

15. Amendments; Waiver; Counterparts; Assignment

15.1 No amendment to this Agreement shall be effective unless in a written instrument signed by both parties. No waiver of any breach shall be effective unless in writing. This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument. Neither party may assign this Agreement without the prior written consent of the other, except that Team may assign to an affiliate in connection with sale or reorganization.

16. Miscellaneous

16.1 The parties acknowledge they have had the opportunity to consult legal counsel and that any headings in this Agreement are for convenience only and do not affect interpretation.
