1. Definitions

For purposes of this Disclaimer: "Stored Property" means all property placed in or on the Unit by Renter; "Loss" means damage, theft, destruction, or loss of Stored Property; and "Owner" includes Owner's agents, employees, affiliates, and contractors.

2. Acknowledgment of Risk

Renter acknowledges and agrees that storage facilities expose Stored Property to risks including but not limited to fire, water damage, pest infestation, theft, vandalism, mold, mildew, and third-party actions. Renter accepts responsibility for selecting appropriate means of storage and securing Stored Property within the Unit.

3. Limitation of Owner Liability

Except for willful misconduct or gross negligence established by final adjudication, Owner shall not be liable for any Loss of or damage to Stored Property. Owner's maximum aggregate liability for any and all claims arising out of or related to the Unit, the Stored Property, or this Disclaimer shall be limited to $. Renter expressly waives any claim for consequential, incidental, special, punitive, or indirect damages.

4. Insurance Requirement

Renter shall, at Renter's sole cost and expense, procure and maintain insurance covering Stored Property while located in the Unit, in an amount not less than the Declared Value of Stored Property. Renter may satisfy this requirement by one or more of the following (select one):

Personal homeowner's or renter's insurance that covers property stored off-premises; or
Purchase of facility-offered insurance or protection plan where available; or
Other insurance acceptable to Owner.

5. Prohibited Items and Hazardous Materials

Renter shall not store hazardous, flammable, explosive, illegal, perishable, or biohazardous materials in the Unit. Renter represents and warrants that the Unit will not contain such items. Renter must immediately notify Owner if Renter discovers prohibited materials in the Unit.

6. Indemnification

Renter shall defend, indemnify, and hold Owner harmless from and against any and all claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising out of Renter's storage of property in the Unit, any breach of this Disclaimer by Renter, or Renter's negligence, except to the extent such claims arise solely from Owner's willful misconduct or gross negligence.

7. Access, Security, and Locks

Renter shall secure the Unit with a lock provided by Renter unless the parties agree otherwise in writing. Owner reserves the right to cut Renter's lock and access the Unit in accordance with the rental agreement or applicable law to protect property, address emergencies, or enforce rights under the rental agreement.

8. Unclaimed Property and Disposition

If Renter fails to pay storage charges or abandons the Unit, Owner may exercise rights under the rental agreement and applicable law to declare the Stored Property abandoned, sell it at public or private sale, or otherwise dispose of it. Proceeds, if any, will be applied in accordance with applicable law.

9. Remedies and Limitation Period

The remedies provided in this Disclaimer are cumulative and in addition to any other remedies available at law or in equity. Any claim arising under or related to this Disclaimer must be brought within one (1) year after the cause of action accrues unless a longer period is required by law.

10. Notices

All notices required or permitted under this Disclaimer shall be in writing and delivered to the addresses set forth below (or to such other address as a party designates by notice).

11. Amendments and Waiver
