Whereas, Tenant is renting from Landlord Apartment No. ______ located at __________ ____________________________________________________________________________ (street address, city, state, zip code), pursuant to that certain Lease Agreement between Tenant and Landlord dated ___________________ (date); and Whereas, Tenant desires to sublet said Apartment to _________________________ (name of sublessee); and Whereas, Tenant’s Lease with Landlord states that Landlord’s permission is required before Tenant can sublet the said Apartment; Now, therefore, for and in consideration of the mutual covenants contained in this agreement, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Landlord does hereby grant permission to Tenant to sublease the said Apartment for a term beginning on __________________ (date) and ending on __________________ (date). 2. Any and all subtenants shall be required to conform to all obligations and covenants of the Tenant as set forth in the above-described Lease Agreement, and all provisions of said Lease Agreement shall remain in full force and effect for the entire term of the sublease. 3. Any and all adult subtenants shall be required to complete the Landlord's standard rental application and must meet the usual character, employment and credit requirements for tenancy. 4. In the event legal action is required to enforce any provision of this Agreement, the
(name of landlord) shall be entitled to retain any subtenants for whom legal action is being taken as provided in this agreement. 5. In the event legal action is required to enforce any term of the above listed lease agreement against a subtenant, said legal action shall be governed by the provisions of the sublease agreement and the subtenant's rights shall be governed by the terms of the sublease agreement. 6. Neither party shall be required to pay any rent or fees to the other party or to landlord. 7. Neither party shall be entitled to receive any benefits, including, but not limited to, benefits and fees of landlord with respect to any rent increase that occurs with the approval or concurrence of the subtenant under the above specified terms of the lease. 8. The landlord shall be entitled to the possession of the premises during the sublease term only for the purpose of making required repairs and performing any repairs, work, replacements, or remodeling of the premises, pursuant to this agreement. 9. The tenant shall be in default of a condition described in the provisions of the lease agreement or any written agreement under which such tenant has paid any portion of the rent. Tenant's default shall be considered a breach of this agreement. Tenant shall be liable to landlord for the amount of the overdue rent and for the costs to reoccupy the property, together with a penalty equal to the total amount of rent and other damages incurred or suffered by landlord as the result of such overdue rent or damages. Tenant may be required to pay a tenant's attorney fees in addition to or in lieu of the penalties herein. 10. In the event of termination of the sublease, the landlord shall pay to tenant and subtenant the amount of any interest or penalty accrued on the amount of rent due by subtenant in excess of the amounts paid by landlord under the lease agreement. 11. No notice of any type other than written notice of termination shall be deemed to be a breach of this agreement unless it is in writing. Failure to comply with any of the provisions of this agreement shall result in the automatic termination of the sublease. 12. This agreement, including but not limited to the terms of any additional obligations undertaken in connection with a rent increase or other increase in the cost of occupancy, shall be enforced by the laws of the state of.
