What the Submission Authorization Release Is and When it Applies

A Submission Authorization Release is a signed document that authorizes a party to submit specified materials, claims, or applications on behalf of another party and to receive related communications. It clarifies the scope of authority, identifies the submitting party, and sets any limits or timeframes for submission. Typical uses include authorizing agents to file administrative applications, permitting third-party submission of sensitive paperwork, and confirming consent for data release to a named recipient. The form helps create a clear record of consent and delegation that can be retained for compliance and audit purposes.

Why a Submission Authorization Release Matters

The form creates a clear, auditable authorization that documents consent, reduces disputes about who may file or receive documents, and supports regulatory and recordkeeping requirements where third-party submission is common.

Why a Submission Authorization Release Matters

Who Typically Completes This Release and Why

Tailor the release to the relationship and the task — narrower authorizations reduce risk and clarify responsibilities.

  • Businesses and compliance teams authorizing outside vendors or attorneys to submit regulatory filings or applications on behalf of the company.
  • Healthcare providers or administrators authorizing release and submission of patient records to insurers or referral partners under specified limits.
  • Individuals who grant power to agents, family members, or brokers to submit benefit claims, applications, or enrollment paperwork.

Core Elements to Include in a Professional Submission Authorization Release

A complete release defines the parties, scope, timeline, data or documents covered, signer consent, and signature authentication. Each element reduces ambiguity and supports enforceability.

Identifying Parties

List full legal names and roles for the grantor and the authorized submitter, including business entity type and contact details to avoid confusion about identity or authority.

Scope of Authorization

Describe precisely what may be submitted (documents, claims, applications), permitted actions (submit, receive notices, respond), and any exclusions — avoid generic wording.

Effective Period

State the start and end dates or events that terminate the authorization, and whether the authorization survives related transactions or transfers of interest.

Data and Privacy Terms

Specify which records or data may be shared, any required confidentiality measures, and references to applicable privacy laws such as HIPAA where health information is involved.

Authentication and Signature

Indicate allowed signature methods (handwritten, electronic) and any required authentication level (ID check, two-factor, notarization, remote online notarization).

Limitations and Liability

Include limits on authority, any indemnities, and statements about whether the submitter may make legal representations on the grantor's behalf.

Step-by-Step: How to Complete a Submission Authorization Release

Follow these steps to prepare a clear, enforceable release and reduce risk of rejection or dispute.

  • 01
Gather IDs: Collect legal IDs and entity documents for all parties.
  • 02
Define scope: Write exact items or actions the submitter may perform.
  • 03
Set timeframe: Enter effective and expiration dates in MM/DD/YYYY format.
  • 04
Sign and authenticate: Sign, date, and obtain any required notarization or witness signatures.

Submitting the Release: Typical Routing and Recipients

The completed release is routed to the receiving organization or filed with the relevant agency; confirm the recipient's required submission method before sending.

  • Submitter sends: Authorized submitter uploads or emails the completed release as directed.
  • Recipient verifies: Receiving party verifies identity and scope before accepting submissions.
  • Agency filing: If an agency is involved, use its prescribed filing channel and include proof of authorization.
  • Record retention: All parties retain signed copies for compliance and audit.

Digital Submission and eSignature Considerations

Use an eSignature platform that supports required authentication, audit trails, and retains a tamper-evident certificate for the signed release.

  • File formats: PDF or DOCX preferred
  • Authentication: Email link, SMS, KBA
  • Notarization: RON or in-person as needed

Key Timing and Processing Expectations

Timing affects both the validity of the authorization and any deadlines for the underlying submission. Confirm recipient timelines before execution.

Immediate Use:

Use the release immediately if submission is urgent.

Processing Window:

Allow 3–10 business days for recipient verification and acceptance.

Agency Deadlines:

Match the release effective date to any statutory filing windows.

Expiration Notice:

Set an explicit expiration date to prevent unintended future use.

Recordkeeping:

Keep signed copies throughout the retention period specified below.

Common Preparation Mistakes to Avoid

  • Vague scope language that omits specific documents or actions, leaving room for disagreement about what was authorized.
  • Mismatched party names or outdated contact details that prevent verification and cause processing delays or rejections.
  • Failing to include an explicit expiration or termination clause, unintentionally granting open-ended authority.
  • Using an unsupported signature method when the recipient requires notarization or higher-assurance authentication.

Consequences of an Incorrect or Missing Authorization

Invalid Submission: Possible rejection
Regulatory Fines: Fines or penalties
Privacy Violations: HIPAA exposure risk
Tax Penalties: 1099 penalties (IRC §6721)
Contract Disputes: Civil liability risk
Authentication Failure: Notarization invalid
