Whereas, this Agreement is being made for the purpose of employing Surveyor to
determine the true boundary line between certain tracts of land owned by Owners;
Now, therefore, for and in consideration of the mutual covenants contained in this
agreement, and other good and valuable consideration, the receipt and sufficiency of
which is hereby acknowledged, the parties agree as follows:
I. Land Involved

II. Services of Surveyor
A. Surveyor shall determine, as nearly as possible, the true boundary line
between the two tracts of land described above. In doing so, Surveyor may rely on the
descriptions in the Deed Books mentioned, on the government field notes of the original
survey of the lands involved, on such monuments, whether natural or otherwise, and
markers or other facts as may have a bearing on the true location of the boundary.
B. Surveyor shall establish new permanent monuments along the boundary
established under this Agreement.
C. Surveyor shall prepare, or cause to be prepared, such quitclaim deeds
between Owners as will, when properly recorded, clearly vest title to the portions of land
that may affect the respective ownerships, according to where such land may lie in regard
to the true boundary line as located by Surveyor.
III. Compensation and Expenses
A. In consideration of the services to be rendered by Surveyor under this
Agreement, Owners agree to pay him a fee of $_____________, with each Owner to pay
one half of such amount.
B. Owners also agree to pay the reasonable expenses of establishing any new
markers along the boundary that Surveyor may erect.
IV. Time for Performance
Surveyor agrees to commence the survey no later than ______________________

V. Mandatory Arbitration
Notwithstanding the foregoing, and anything herein to the contrary, any dispute
under this Agreement shall be required to be resolved by binding arbitration of the parties
hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator
and both arbitrators shall then select a third. The third arbitrator so selected shall
arbitrate said dispute. The arbitration shall be governed by the rules of the American
Arbitration Association then in force and effect.
This Agreement may be executed in any number of counterparts, each of which
shall be deemed to be an original, but all of which together shall constitute but one and
the same instrument.
