WHEREAS, Participant Name: desires to enroll in the Services and agrees to the terms and conditions set forth in this Registration and Instruction Agreement (the "Agreement").

Scope of Work

The Provider will provide swim instruction, pool access during scheduled class times, and qualified instruction personnel as described below. Participant acknowledges that instruction includes in-water coaching, dry-land instruction and safety briefings. The Provider will deliver instruction in accordance with generally accepted swim-teaching standards and applicable facility rules.

Payment Terms

Tuition and fees are due according to the schedule below. Late payments are subject to the stated late fee. Participant remains responsible for all fees incurred under this Agreement.

Term and Termination

This Agreement commences on the Session start date below and continues through the Session end date unless earlier terminated in accordance with this section.

Confidentiality

Both parties agree that any non-public business information, student progress reports, proprietary teaching materials, and other confidential information disclosed in connection with this Agreement shall be held in confidence and not disclosed to third parties except as required by law. Confidential information does not include information that is or becomes publicly available through no fault of the receiving party.

Waiver, Assumption of Risk, and Release

Participant and, where applicable, Participant's parent or guardian, acknowledges that aquatic activities involve inherent risks including but not limited to drowning, slips, collisions, and other injuries. By enrolling, Participant assumes all risks associated with participation and agrees to release, indemnify and hold harmless the Provider, its employees, agents and facility owners from any claims, liabilities, losses or expenses arising out of Participant's participation except where caused by the Provider's gross negligence or willful misconduct.

Photo and Video Release

I grant permission for photographs and video recordings of the Participant to be used by the Provider for program promotion, training, and educational purposes, subject to the Provider's confidentiality obligations. No compensation will be provided for such uses.

Cancellation & Refund Policy

Cancellations made in writing at least the specified notice period prior to the first scheduled class are eligible for refund per Provider policy, less any non-refundable deposit. Cancellations after the start of a session are subject to the Provider's pro rata refund rules. Provider may cancel classes for operational reasons and will offer a make-up class or refund for cancelled sessions.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of without regard to conflict of laws principles. Venue for any dispute arising under this Agreement shall lie in the county where the Provider's principal place of business is located.

Entire Agreement

This Agreement, including any attachments and the Provider's enrollment policies as provided at the time of registration, constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior negotiations, representations, or agreements, whether written or oral. No amendment shall be binding unless in writing and signed by both parties.

Consent to Emergency Medical Treatment

If emergency medical treatment is necessary, the undersigned authorizes the Provider to seek medical care for the Participant and to transport the Participant to a medical facility if deemed necessary. The undersigned agrees to be financially responsible for any costs incurred.
