Swim Club Membership Agreement

This Swim Club Membership Agreement ("Agreement") is entered into between the Swim Club Representative and the Member as of the Effective Date set forth below.

Recitals

WHEREAS, the Swim Club operates aquatic facilities, programs and services including pool access, swim instruction and organized activities; and

WHEREAS, the Member desires to obtain membership privileges and access to Club facilities and programs under the terms and conditions set forth herein; and

WHEREAS, the Swim Club agrees to provide access and services to the Member in consideration of the Member's payment of membership fees and compliance with Club rules.

Scope of Services

The Swim Club will provide the Member with access to the Club's aquatic facilities and related services as selected by the Member below, subject to Club rules, scheduling and capacity limitations.

Payment Terms

The Member shall pay the Swim Club the membership fees and charges described below in consideration for the privileges granted. All fees are non-transferable except as expressly permitted by the Club in writing.

All fees not received by the due date are subject to the stated late fee and any collection costs incurred by the Club. The Club may suspend Member privileges for nonpayment after providing written notice as described in the Term and Termination section.

Term and Termination

This Agreement commences on the Effective Date and continues through the Expiration Date unless earlier terminated in accordance with this Agreement.

The Club may terminate this Agreement immediately for material breach, safety violations, falsification of membership information, or repeated nonpayment. The Member may terminate this Agreement by providing the Club the notice set forth above and paying any fees due through the effective date of termination. Any prorated refunds, if permitted by Club policy, will be calculated in accordance with the Club's published refund practices.

Member Acknowledgements and Rules

The Member acknowledges that use of aquatic facilities involves inherent risks, including drowning, injury and illness. The Member agrees to comply with all posted rules and instructions from Club staff, to supervise minor family members where applicable, and to ensure that all permitted guests comply with Club rules. The Member accepts responsibility for the conduct of any dependents or guests.

Confidentiality

Each party shall keep confidential and not disclose to third parties any non-public business, financial or personal information of the other party learned in connection with this Agreement, except as required by law or necessary to perform the obligations hereunder. Confidential information shall not include information that is publicly known through no fault of the receiving party or already known to the receiving party at the time of disclosure.

Liability and Indemnity

The Member releases the Swim Club and its officers, employees and agents from liability for personal injury, property damage or loss that arises from ordinary negligence while using Club facilities, to the fullest extent permitted by law. The Member shall indemnify and hold harmless the Club from claims arising from the Member's negligent actions or failure to follow Club rules.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of , without regard to its conflict of laws principles.

Entire Agreement

This Agreement, together with any written Club policies incorporated herein, constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior proposals, negotiations and communications, whether oral or written. Any amendment or waiver must be in writing and signed by both parties.
