What the Telework Policy Agreement Is and When It Applies

A Telework Policy Agreement is a formal written document that defines remote work arrangements between an employer and an employee, covering eligibility, hours, equipment, security, expectations, and termination. It documents responsibilities for work performance, data protection, expense reimbursement, and use of employer property while working offsite. The agreement creates clarity on supervision, schedule changes, and insurance or tax implications. Employers use it to set uniform standards; employees use it to confirm the rules that govern telework and any business-related reimbursements or allowances.

Why a Clear Telework Policy Agreement Matters

A written agreement reduces misunderstandings, sets consistent expectations, and helps manage legal and security risks associated with remote work.

Why a Clear Telework Policy Agreement Matters

Who Typically Completes and Signs a Telework Policy Agreement

Common signers include employees and their direct managers; HR or legal often review and retain the executed document.

  • Remote and hybrid employees confirming eligibility and work conditions
  • HR professionals implementing consistent telework rules across teams
  • Managers approving role-specific telework arrangements and schedules

Use consistent routing so HR receives a final signed copy for personnel files and compliance tracking.

Core Sections to Include in a Professional Telework Policy Agreement

A complete agreement organizes terms so each party understands obligations and enforcement. Use clear, numbered sections and attach relevant exhibits such as equipment inventories or security checklists.

Eligibility

Criteria for telework, probationary status, and approval process tailored to job roles and business needs.

Work Hours

Standard hours, time reporting requirements, availability expectations, and overtime rules where applicable.

Equipment

Inventory, ownership, maintenance, permitted personal device use, and return conditions at termination.

Security

Data protection, VPN/endpoint requirements, encryption, access controls, and breach reporting procedures.

Expenses

Reimbursable costs, documentation required, approval thresholds, and tax treatment of reimbursements.

Termination

Circumstances for modifying or revoking telework privileges and steps to return to on-site work.

Step-by-Step: Completing and Approving the Agreement

Follow these steps to prepare, review, and finalize a Telework Policy Agreement in sequence to ensure compliance and record retention.

  • 01
Draft: Prepare the agreement using company template and populate employee-specific fields.
  • 02
Review: Have HR and the manager confirm role eligibility and required clauses.
  • 03
Sign: Obtain electronic signatures from employee and manager; HR countersign when applicable.
  • 04
File: Store the executed copy in the personnel file and share a copy with the employee.

Customizing the Agreement Workflow for Online Completion

Configure a digital workflow to route drafts for approval, apply conditional fields, and capture audit logs for compliance.

Field Configuration
Routing Order Set sequential reviewers: Employee → Manager → HR
Conditional Sections Show equipment and expense sections only if employer provides items or reimbursements
Authentication Use email link plus SMS code or SSO for higher-assurance signers
Retention Automatically save signed PDF to HR folder and record audit trail

Digital Signing and eSubmission: Technical Requirements

Ensure the eSignature solution supports required authentication, audit trails, and secure storage for personnel records.

  • File Formats: PDF, DOCX accepted for upload and final signed PDF export
  • Integrations: Connect to HRIS or cloud storage (e.g., Google Workspace, Microsoft 365, NetSuite)
  • Authentication: Support email, SMS code, SAML/SSO, and optional KBA for sensitive signings

Maintain an audit trail (timestamps, IP, signer identity) and retain signed records per company retention schedule.

Where to Send and How Signed Agreements Are Routed

A standard routing flow helps HR track approvals, store records, and apply any follow-up actions such as issuing equipment or adjusting payroll.

  • Employee: Completes fields and signs; confirms contact details for emergency and tax purposes
  • Manager: Approves schedule and responsibilities; verifies operational feasibility
  • HR: Countersigns, files executed copy in personnel record, updates eligibility trackers
  • IT: Receives equipment request and configures remote access per security policy
