The parties agree the Child's timesharing shall occur as follows. The description below shall control over any prior informal arrangements unless subsequently amended in writing.

4. Decision-Making Authority

Unless otherwise provided in this Agreement, Parent/Legal Guardian retains decision-making authority for major long-term matters affecting the Child (including major medical treatment, major educational placement decisions, and religion). Temporary Caregiver is authorized to make routine day-to-day decisions for the Child's care and to consent to emergency medical treatment as necessary to preserve the Child's health and safety.

17. Counterparts and Electronic Signatures

This Agreement may be executed in counterparts, each of which shall be deemed an original, and all of which together shall constitute one and the same instrument. Signatures transmitted by electronic means shall be deemed to have the same force and effect as original signatures.

What a Temporary Custody Timesharing Agreement Is and When It Applies

A Temporary Custody Timesharing Agreement is a written arrangement that documents short-term custody, visitation, or parenting-time allocations for a minor without changing legal custody. It records who cares for the child, the daily schedule, decision-making limits, contact information, and any special instructions for healthcare, education, or travel. These agreements are commonly used for temporary caregiving by relatives, friends, or agencies and can be executed privately, notarized, or submitted to a family court depending on state or case requirements.

Why a Clear Temporary Custody Timesharing Agreement Matters

A well-drafted temporary timesharing agreement reduces uncertainty, protects parental and caregiver responsibilities, and documents consent for medical or educational decisions. It helps avoid disputes and provides evidence of intent and permission should authorities or schools request proof of authority.

Why a Clear Temporary Custody Timesharing Agreement Matters

Who Commonly Completes a Temporary Custody Timesharing Agreement

Typical parties include parents, temporary caregivers, relatives, foster or kinship caregivers, and legal guardians who need a written plan for short-term care.

  • Parents arranging short-term transfers while traveling or deployed, documenting dates, emergency contacts, and medical consent.
  • Relatives or family caregivers receiving temporary responsibility for routines, pickup/drop-off, and school communications.
  • Agencies or foster providers documenting authorized timesharing and limits for temporary placements or respite care.

The agreement also benefits schools, medical providers, and third parties that require documented permission to provide services or make decisions for the child.

Who Signs and Their Roles

Custodial Parent

A parent or legal guardian with primary custody signs to authorize specified temporary timesharing. Their signature confirms consent for care, medical decisions within stated limits, and the duration of the arrangement; use exact full legal name to avoid identity issues.

Temporary Caregiver

A relative, friend, or licensed caregiver who accepts temporary responsibility signs to acknowledge receipt of care duties and any limits on decision-making; include contact information, acceptance of terms, and emergency procedures.

Essential Data Elements to Include

Risks of an Incomplete or Incorrect Agreement

Medical Delays: Treatment postponed
Legal Challenge: Court may set aside

Child Welfare Inquiry: Agency investigation

Common Preparation Pitfalls to Avoid

  • Using informal language or vague terms (for example, 'as needed') that leave decision-making authority unclear and invite disputes.
  • Not including precise dates and times for the temporary custody period, which can lead to conflicting interpretations by caregivers or third parties.
  • Failing to list emergency contacts, medical insurance details, or allergy/medication information, increasing risk during urgent care situations.
  • Omitting signature dates, printed names, and relationship to the child; unsigned or undated agreements may be rejected by institutions.

Key Clauses to Include in a Professional Agreement

A reliable temporary custody timesharing agreement is concise but complete. Include explicit authority limits and practical instructions to reduce questions from third parties.

Effective Term

Clear start and end dates, with specific times if needed; include automatic extension or early-termination procedures to prevent ambiguity if plans change mid-period.

Scope of Authority

Describe what actions the temporary caregiver may take (medical decisions, school pick-up, consent to routine care) and list any express prohibitions to avoid second-guessing.

Emergency Care

Provide medical insurance details, primary physician contact, authorization for emergency treatment, and known allergies or medication instructions to expedite care.

Travel Permissions

If travel is permitted, state geographic limits, travel companions, and whether consent for international travel or crossing state lines is granted; include required documentation.

Signatures & Witnesses

Include printed names, dated signatures, and witness or notary acknowledgment where state law or institutions require notarization or witnessing for acceptance.

Revocation Terms

State how the agreement may be revoked early, who may revoke it, notice procedures, and any conditions that automatically terminate the temporary arrangement.
