Severability: If any provision of this Application is held to be invalid or unenforceable, such invalidity or unenforceability shall not affect the remaining provisions, which shall remain in full force and effect.

10. AMENDMENTS; WAIVER; COUNTERPARTS

Waiver: The failure of either party to enforce any provision of this Application shall not be construed as a waiver of that provision or any other provision of this Application.
