TENANT AGREEMENT CONTRACT

This Tenant Agreement Contract ("Agreement") is made and entered into on Effective Date: by and between Landlord Name: whose address is ("Landlord"), and Tenant Name: whose address is ("Tenant").

RECITALS

WHEREAS, Landlord is the legal owner of the real property and improvements located at: (the "Premises");

WHEREAS, Tenant desires to lease the Premises from Landlord for residential purposes and Landlord agrees to lease the Premises to Tenant on the terms set forth herein;

NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the parties agree as follows:

The term of this Lease shall commence on Start Date: and shall continue until End Date: unless sooner terminated in accordance with this Agreement. If a fixed term is not specified, this Agreement shall be month-to-month beginning on the commencement date.

3. RENT

Tenant shall pay to Landlord monthly rent in the amount of $ payable in advance on or before the day of each month. All payments shall be made to Landlord at Landlord's address for notices or at such other place designated by Landlord in writing. If rent is not received within days after the due date, Tenant shall pay a late fee of $ and interest thereafter at the maximum lawful rate.

Tenant shall deposit with Landlord upon execution of this Agreement the sum of $ as security for Tenant's performance of its obligations hereunder. Landlord may apply all or part of the deposit to cure defaults, repair damage caused by Tenant beyond normal wear and tear, and to clean the Premises upon termination. Any remaining balance will be returned to Tenant in accordance with applicable law.

7. MAINTENANCE AND REPAIRS

Tenant shall notify Landlord promptly of any condition that requires repair. Tenant shall be liable for damage caused by Tenant's negligence or misuse. Landlord shall make reasonable efforts to effect necessary repairs within a commercially reasonable time after receipt of written notice.

8. ALTERATIONS

Tenant shall not make any structural alterations, additions or improvements to the Premises without the prior written consent of Landlord. Any approved alterations shall be performed in a good and workmanlike manner, shall comply with all laws, and shall become part of the Premises unless otherwise agreed in writing.

9. ENTRY BY LANDLORD

Landlord or Landlord's agents may enter the Premises in emergencies without prior notice. For non-emergency entry, Landlord shall provide at least days' notice and may enter during reasonable hours to inspect, make repairs, show the Premises or for other lawful reasons. Landlord shall comply with applicable statutory requirements regarding notice of entry.

10. INSURANCE AND LIABILITY

Tenant is encouraged to obtain renters' insurance covering Tenant's personal property and liability. Landlord's insurance, if any, does not cover Tenant's personal property. Tenant shall be liable for loss or damage resulting from Tenant's negligence and shall indemnify and hold Landlord harmless from claims arising out of Tenant's use of the Premises except to the extent caused by Landlord's gross negligence or willful misconduct.

11. DEFAULT; REMEDIES

If Tenant fails to pay rent or otherwise defaults under this Agreement, Landlord shall provide a written notice specifying the default and Tenant shall have a cure period of days to cure where cure is possible. If Tenant fails to cure within the required time, Landlord may pursue all remedies available at law or in equity, including termination of the tenancy, recovery of damages, and collection of unpaid sums plus costs and attorney's fees to the extent permitted by law.

12. ASSIGNMENT AND SUBLETTING

Tenant shall not assign this Agreement or sublet the Premises, or any part thereof, without Landlord's prior written consent, which shall not be unreasonably withheld. Any assignment or subletting without such consent shall be void and shall constitute a material breach.

13. PETS

Pets: Permitted Prohibited. If pets are permitted, Tenant shall pay a non-refundable pet deposit of $ and shall be responsible for all damages caused by such pets.

14. HOLDOVER

If Tenant remains in possession of the Premises after the expiration of the term without Landlord's written consent, Tenant shall be a holdover tenant and shall be liable for damages, including increased rent at a rate equal to of the prior rent, or as otherwise provided by law.

All notices required or permitted under this Agreement shall be in writing and shall be deemed delivered when personally delivered, delivered by nationally recognized overnight courier, or three (3) days after deposit in the United States mail, postage prepaid, certified or registered, return receipt requested, addressed to the respective party at the address set forth in the opening paragraph or at such other address as either party may designate by written notice to the other.

Any amendment or modification to this Agreement must be in writing and signed by both parties. The failure of either party to enforce any right or remedy under this Agreement shall not constitute a waiver of that right or remedy. This Agreement may be executed in counterparts, each of which shall be deemed an original and all of which together shall constitute one instrument.
