What a Tenant Rental Agreement Is and When it Applies

A Tenant Rental Agreement is a written contract between a landlord (or property manager) and a tenant that sets the terms for occupancy of residential or commercial premises. It typically covers the lease term, rent amount and due dates, security deposit handling, permitted uses, maintenance responsibilities, and procedures for notices and termination. Properly drafted and executed agreements create enforceable rights and obligations, allocate risk, and document essential details such as tenant identity and property description. Electronic copies and signed records are legally acceptable in the United States under federal and state e-signature laws when executed correctly.

Why a Clear Tenant Rental Agreement Matters and Its Legal Basis

A clear Tenant Rental Agreement reduces disputes, defines payment and repair responsibilities, and preserves landlord and tenant remedies. It also documents conditions needed for security deposit returns, subletting rules, and early termination terms.

Why a Clear Tenant Rental Agreement Matters and Its Legal Basis

Essential Sections to Include in a Professional Tenant Rental Agreement

A professional Tenant Rental Agreement is organized so each party’s rights and duties are explicit, with measurable dates, monetary amounts, and dispute procedures. Include exhibits where needed for condition reports or rules.

Parties

Identify landlord and tenant by full legal name and business entity type; include contact information and emergency contact details.

Premises

Describe the rental unit with street address, unit number, and included parking or storage; attach floor plan or access details if necessary.

Term

Specify lease start and end dates, renewal options, and any holdover provisions with clear date formats (MM/DD/YYYY).

Rent & Payment

State monthly rent amount, due date, accepted payment methods, late fees, grace periods, and returned-check penalties.

Security Deposit

Document deposit amount, allowed deductions, interest (if required by law), and the timeframe and method for returning funds.

Repairs & Access

Assign maintenance responsibilities, emergency repair procedures, and landlord access notice requirements for inspections or repairs.

Step-by-Step: Complete and Execute a Tenant Rental Agreement

A typical signing workflow includes preparing the template, collecting tenant data, and capturing legally valid signatures with a retained audit trail.

  • 01
Prepare Template: Upload a curated lease or use a city/state-compliant template.
  • 02
Add Required Fields: Insert name, address, rent, deposit, and signature fields precisely.
  • 03
Set Authentication: Choose signer verification method (email, SMS code, or stronger).
  • 04
Send and Collect: Distribute to signer(s), capture signatures, and store copies securely.

How to Configure an Online Tenant Rental Agreement Workflow

Set up a repeatable digital workflow for tenancy agreements so each execution includes the same fields, authentication, and retention policies.

Field Configuration
Upload Template PDF or DOCX, standardize clauses and exhibits
Field Placement Names, dates, rent, deposit, initials, signature
Signing Order Sequential or parallel signer routing
Authentication Email link, SMS code, KBA or advanced options

Technical Considerations for Digital Signing and eSubmission

Ensure the signing platform supports the file formats and authentication levels your process requires before sending Tenant Rental Agreements.

  • Supported Formats: PDF, DOCX, and fillable forms
  • Integrations: Connectors for Google Workspace, Microsoft 365, Salesforce
  • Authentication: Email, SMS, or advanced signer verification

Verify audit trails, encryption in transit and at rest, and ability to export signed PDFs and signed certificates for storage and compliance.

Where to Send, File, and Deliver a Signed Tenant Rental Agreement

After signatures are collected, distribute execution copies to all parties, store a signed master copy, and place exhibits or move-in checklists with the lease record.

  • Tenant Copy: Email signed PDF to tenant automatically
  • Landlord File: Store master signed document in property folder
  • Accounting: Send rent schedule and deposit receipt to accounting
  • Third Parties: Provide copies to co-signers, guarantors, or property managers

Key Timing Rules and Typical Deadlines to Include

The lease should state specific deadlines for payment, notices, and deposit returns; some timelines vary by state so make them explicit in the agreement.

Rent Due Date:

Specify day each month and grace period if any

Late Fee Policy:

State late fee amount or percentage and effective day

Security Deposit Return:

Specify return timeframe and inspection process

Notice to Terminate:

State notice periods for tenant and landlord

Move-in Inspection:

Document condition within first few days

Common Mistakes to Avoid When Preparing a Tenant Rental Agreement

  • Leaving blanks for rent or deposit amounts that later lead to disputes and unenforceable terms.
  • Using inconsistent name formats across ID, lease, and payment records; this complicates enforcement and background checks.
  • Failing to document move-in condition and attached exhibits, which increases deposit disputes at move-out.
  • Skipping explicit notice address and delivery method; ambiguous notice clauses generate litigation over receipt dates.

Risks and Legal Consequences of an Incorrect or Incomplete Agreement

Eviction Notice Exception: Certain eviction and foreclosure notices may be excluded from e-signature laws
Security Deposit Violations: State penalties for improper withholding or late return
Unenforceable Terms: Ambiguous rent or term clauses may be voided by courts
Ineffective Notices: Poorly drafted notice provisions can delay remedies
Name Mismatch: Incorrect tenant name can impede court filings and tax reports
Late Filing: Failure to register or file required local forms risks fines

Security and Compliance Elements to Include with the Agreement

Encryption: TLS 1.2/1.3 in transit; AES-256 at rest
Audit Trail: Timestamps, IP, and action history retained
Access Controls: Role-based permissions and account security
BAA Availability: HIPAA BAA available where health data involved
Certifications: SOC 2 Type II and ISO 27001 compliance
Retention Options: Exportable signed PDFs and compliance logs

These short cases illustrate how property professionals use digital signatures to streamline leasing and maintain compliance without in-person meetings.

Tim Martin, Founder, Martin Properties used digital signing to process leases remotely

  • Reduced in-person signings and sped turnarounds by consolidating paperwork
  • The result was faster occupancy and consistent compliance across mobile and desktop workflows.

Optica Ventures

Brian Fitzgibbons, COO, Optica Ventures LLC simplified tenant onboarding with online leases

  • Tenants signed from multiple devices without visiting the office
  • This produced clearer records and fewer follow-up questions during move-in.

Who Commonly Completes a Tenant Rental Agreement

A variety of people and organizations complete rental agreements depending on property type and process design.

  • Individual landlords and small property managers who self-manage units and need repeatable templates for each tenancy.
  • Large property management firms and leasing agents handling high-volume rentals and uniform lease execution across portfolios.
  • Tenants and guarantors who must sign remotely during application approval, background checks, or corporate relocation.

Choose the workflow and authentication level that matches the risk profile—higher-value leases and corporate tenancies typically require stronger signer verification.

Typical Signatories and Their Roles

Landlord — Property Owner

The landlord or authorized agent signs to grant occupancy and accept lease terms. Include corporate title when an entity signs and ensure the signer has authority to bind the landlord and accept rent and deposit terms.

Tenant — Renter or Corporate Lessee

The tenant signs to accept obligations such as rent, maintenance responsibilities, and rules. If a guarantor or co-tenant exists, their signature and printed name should be captured along with contact and ID details.
