What a Tire and Wheel Agreement Covers

A Tire and Wheel Agreement is a written contract that documents the sale, installation, maintenance, warranty, and allocation of liability for tires and wheels between a seller or service provider and a customer. Typical provisions define the parties, describe covered items and services, specify pricing and payment terms, set warranty scope and duration, allocate risk for damage or improper fitment, explain return or repair procedures, and identify governing law and dispute resolution. This document creates enforceable expectations for performance, claims handling, and post-service obligations for both commercial fleets and retail customers.

Why a Dedicated Agreement Matters

A clear Tire and Wheel Agreement reduces disputes, clarifies warranty limits, and preserves evidence for claims. It allocates responsibilities for inspection, installation torque, road hazard coverage, and post-installation damage, and it helps ensure compliance with consumer disclosure rules and industry best practices while supporting easier claims handling.

Why a Dedicated Agreement Matters

Who typically creates and signs this agreement

Use the agreement whenever goods or services involve safety-critical fitment, extended warranties, or third-party billing to document obligations clearly.

  • Independent repair shops and tire retailers that sell, mount, and balance tires for retail customers and commercial accounts.
  • Fleet managers and logistics companies that purchase tires and wheels for multiple vehicles and require centralized billing and warranty tracking.
  • Insurance adjusters and claims handlers who document covered road-hazard repairs and payment responsibilities.

Common signing parties

Service Manager

A shop manager or owner who signs on behalf of the vendor. They confirm product details, installation procedures, and warranty options and accept financial responsibility for the business commitments.

Fleet Manager

An authorized representative for a commercial fleet who signs for purchase orders and service contracts. They control billing, approve bulk pricing, and handle claims across multiple vehicles.

Invoice Delivery:

Issue within billing cycle to avoid late-payment disputes

Record Retention:

Keep financial records at least 3 years per IRS rules

Consumer Disclosures:

Common mistakes to avoid

  • Using vague item descriptions that lead to disputes over correct replacements and void warranty claims.
  • Failing to obtain an authorized signature or using initials where a full signature is required for enforcement.
  • Not documenting inspection findings or torque verification, which can shift liability after an installation.
  • Mixing separate service agreements (alignment, tire replacement) without clear price breakdowns and authorization.

Risks and potential consequences of incomplete agreements

Warranty Denial: Excluded for improper documentation
Liability Exposure: Installation errors may create legal claims
Billing Disputes: Unclear terms can delay payment
Regulatory Fines: Failure to keep records may trigger penalties
Insurance Rejection: Incomplete proof may void coverage
Contract Litigation: Ambiguous clauses increase dispute risk

Practical use examples

Two short scenarios show how the agreement supports routine sales, fleet purchases, and warranty claims.

Retail Sale Scenario

A customer purchases four tires and requests road-hazard protection

  • The shop documents brand, DOT codes, and warranty selection
  • Signed agreement clarifies coverage, price, and repair process, allowing faster claims handling and a clear basis for any denial.

Fleet Purchase Scenario

A transportation company orders 50 tires for a fleet replacement

  • The agreement attaches a purchase order and billing instructions
  • Centralized contract terms and electronic records streamline invoicing, warranty claims, and preventive maintenance scheduling across vehicles.
