What the Tire Mart Agreement Covers

The Tire Mart Agreement is a standardized commercial contract used between Tire Mart (a tire retail and service provider) and a customer, supplier, or commercial partner to record the sale, installation, warranty terms, and ongoing service obligations for tires and related automotive work. It defines parties, scope of work, pricing, payment terms, delivery or appointment scheduling, limited warranties, and dispute resolution. The agreement is structured to support electronic completion and signing, and can be executed on paper, via remote online notarization where permitted, or using compliant eSignature platforms that meet ESIGN and UETA requirements.

How a Clear Agreement Reduces Risk

A concise Tire Mart Agreement reduces disputes by documenting work scope, payment expectations, warranty coverage, and liability allocation. It provides an auditable record for warranty claims, insurance, collections, and regulatory review while clarifying remedies and timelines for both parties.

How a Clear Agreement Reduces Risk

Who Prepares and Signs This Agreement

Typical users who prepare, review, or sign Tire Mart Agreements include retail managers, service advisors, fleet managers, and independent contractors handling installation and maintenance.

  • Retail store managers responsible for sales, pricing decisions, and executing customer agreements at point of sale.
  • Service advisors scheduling appointments, documenting repairs, and confirming warranty scope with customers.
  • Fleet managers and corporate buyers negotiating bulk pricing, service-level agreements, and centralized billing arrangements.

Legal, finance, and procurement teams may review standard form changes; customers and suppliers should verify terms before signing.

Practical Examples of Use

Two real-world scenarios illustrate how a standardized agreement improves processing and compliance.

Optica Ventures — Fleet Management

Optica Ventures centralized tire purchases and service scheduling across multiple sites to reduce administrative overhead.

  • Simple interface reduced signer confusion during rollout.
  • As a result, the company standardized terms, shortened approval cycles, and created a single source of executed agreements for warranty and billing reconciliation.

Martin Properties — Property Maintenance

A property services firm used a standard agreement for tire replacement on company vehicles to ensure consistent warranty handling.

  • Faster execution with digital forms reduced turnaround time.
  • The firm retained complete audit trails for each transaction, simplifying vendor reconciliation and dispute resolution with tenants and insurers.

Common Preparation Mistakes to Avoid

  • Leaving the scope vague or omitting vehicle details causes disputes about work performed and may lead to warranty claim denials or billing disagreements.
  • Using nicknames or omitting corporate suffixes can invalidate a signer’s authority; corporate signers should attach a resolution or power of attorney to confirm authority.
  • Failing to itemize taxes or disposal fees leads to undercollection and potential tax reporting errors for both parties.
  • Neglecting consumer notice requirements or paper consent options where required can create statutory issues under ESIGN consumer disclosure rules.

Risks and Penalties from Errors or Omissions

Late Payment Penalty: Late fees, collection costs may apply
Incorrect Tax Info: Backup withholding at 24% may be triggered
Invalid Signature: Potential non-enforceability without intent evidence
Failure to Notarize: May complicate disputes in some states
Breach of Contract: Damage claims, termination, and litigation risk
Tax Filing Penalties: IRC §6721 penalties can apply for incorrect returns

Practical Tips for Smooth Execution

Adopt consistent processes and controls to reduce errors and accelerate signature completion.

Use a Standard Template
Maintain a single approved form to ensure consistent terms, reduce attorney review need, and make bulk updates manageable across locations.
Require Identity Verification
Use at least email plus SMS or SSO for business signers; require corporate authority documentation for entity signers to avoid later disputes.
Archive Executed Copies
Store signed agreements with audit trails and read-only access; retain per retention schedule to support warranty and tax inquiries.
Review Pricing Clauses Regularly
Update tax, disposal, and environmental fees proactively and document revision dates to avoid billing disputes.

Key Timing and Processing Expectations

Establish timelines for review, signature, service delivery, and warranty claims to set expectations and support enforcement.

Signature Turnaround:

Expect execution within 24–72 hours for emailed signing requests in most cases.

Service Scheduling:

Schedule installation within the agreed appointment window; confirm any lead times in the SOW.

Warranty Claims:

Require claim initiation within the stated warranty period and follow specified claim procedures.

Price Adjustments:

Provide written notice of price changes as specified by the agreement before they apply.

Record Retention:

Archive executed agreements immediately and index by account and VIN where applicable.
