Issuer shall indemnify and hold harmless Provider and its officers, directors, employees, and agents from and against any liabilities, losses, damages, costs, and expenses (including reasonable attorneys' fees) arising from Issuer's breach of this Agreement, any false representation by Issuer, or from claims by third parties arising from Issuer's asserted title interest, except to the extent caused by Provider's gross negligence or willful misconduct.

Entire Agreement

What a Title Notice Template Is and When It’s Used

A Title Notice Template is a standardized written form used to notify parties of a title-related condition, exception, or defect affecting real property. It outlines the issue, identifies the parcel or legal description, states the action requested or required, and records dates and contact information for follow up. The template helps create a clear, consistent record for lenders, title companies, buyers, sellers, and recording officials, and can be delivered as a physical document or an electronic record under applicable e-signature laws.

Why a Clear Title Notice Matters

A consistent Title Notice Template reduces ambiguity, speeds resolution of title exceptions, and creates a provable record of notice and consent. Properly completed notices support recordation and help manage lien priority, closing timelines, and dispute risk under applicable state recording rules and federal e-signature law.

Why a Clear Title Notice Matters

Who Typically Prepares and Receives This Notice

The template creates a single reference document for all parties and supports later recording or dispute resolution if necessary.

  • Title and escrow officers — Prepare notices to clear exceptions before closing and communicate with underwriters.
  • Lenders and servicers — Document title defects affecting collateral and request remedies or cures.
  • Buyers, sellers, and attorneys — Receive notice of encumbrances, survey exceptions, or corrective actions needed.

Core Elements of a Professional Title Notice Template

A complete template groups identifying data, issue description, remedial steps, authority and signature blocks, and recordation instructions so recipients can act without follow-up questions.

Property ID

Legal description and parcel number with street address to ensure filing and title search accuracy and avoid misidentification at the recorder's office.

Issue Summary

Concise description of the title exception, lien, encroachment, or missing document, including reference to deed book, instrument number, or recorded document when available.

Required Action

Specific remedial steps requested (curative deed, lien release, corrected instrument), plus deadlines and responsible party designation for tracking.

Signature Block

Signer name, capacity (e.g., trustee, grantor, authorized officer), date, and space for notarization or e-signature evidence if required for recording.

Contact Details

Name, firm or company, phone, email, and mailing address for questions or delivery of cure documents and proof of correction.

Recording Instructions

Notes on where to record, fee payer, preferred form of return, and any county-specific requirements to avoid rejection at the recorder's office.

Required Information Checklist

Legal Description: Full parcel description
Instrument Reference: Deed book or ID
Party Names: Full legal names
Effective Date: MM/DD/YYYY
Signature Type: Wet or e-sign
Notarization: As required

Step-by-Step: Fill, Authenticate, and Share the Notice

Follow these four core steps to prepare and circulate a Title Notice Template correctly so it can support recording or remediation without delay.

  • 01
Prepare: Complete property and issue fields accurately.
  • 02
Authenticate: Apply required signature and notarization.
  • 03
Deliver: Send to affected parties and title insurer.
  • 04
Record: Record with the county if required or retain proof of notice.

Configuring an Online Title Notice Workflow

When building an electronic workflow, define fields, signer order, and authentication to match recording and underwriting requirements.

Field Configuration
Property Description Required, multiline text
Signer Role Set signer order and capacity
Authentication Email + SMS or ID verification
Return Method PDF with audit trail

Where to Send or File the Completed Notice

Route the completed notice to parties and, if applicable, the county recorder or title insurer in the prescribed format to effect notice and support recordation.

  • To Parties: Email and certified mail options
  • To Title Company: Upload to escrow or underwriting portal
  • To Recorder: Follow county submission rules
  • For Lender Files: Store in loan origination system

Digital Signing and File Format Considerations

Keep a copy in a secure document system with an audit trail and export options so signed notices can be produced for underwriters or courts as needed.

  • File Formats: PDF/A or PDF preferred
  • Authentication: Email + SMS or stronger
  • Integrations: CRM or title platforms

Typical Timelines and What to Expect

Timelines vary by county and transaction; include realistic windows in the notice so recipients can prioritize corrective actions and recording steps.

Immediate Acknowledgement:

Request confirmation within 7–14 days of notice delivery.

Cure Period:

Specify a cure deadline—commonly 10–30 days based on agreement.

Recording Timeframe:

County recording often takes 1–4 weeks depending on backlog.

Title Re-exam:

Allow 5–10 business days for underwriter review.

Escrow Hold:

Resolves prior to closing or per escrow instructions.

Common Preparation Errors to Avoid

  • Using an incomplete legal description that mismatches county records, causing recording rejection or misfiled notices.
  • Failing to show signer capacity (e.g., trustee, corporate officer), which can create questions about authority to act.
  • Skipping notarization or required RON steps where the county or underwriter mandates it, delaying acceptance.
  • Sending the notice without retaining an execution audit trail, leaving no proof of delivery or signature attribution.

Potential Consequences of an Incorrect or Missing Notice

Recording Delay: Delayed transfer
Lien Priority Risk: Priority disputes possible
Underwriter Refusal: Policy exceptions remain
Closing Postponement: Settlement can be delayed
Increased Costs: Attorney and re-filing fees
Litigation Risk: Possible title disputes
