What the Title Release Affidavit Form Is

A Title Release Affidavit Form is a sworn written statement used to document the release or transfer of an ownership interest in personal property covered by a certificate of title, most commonly motor vehicles. Parties use it to confirm that a lien has been satisfied, that the seller has relinquished title, or that a lender authorizes release of a title hold. The affidavit records key facts under penalty of perjury, identifies the parties and vehicle, and provides a dated signature and notarization where required by state law. Accurate completion supports clear title chain and helps prevent registration delays.

Why the Form Matters for Title Clarity

Use a Title Release Affidavit Form to create a documented, sworn record that a lien or title interest has been released, reducing registration problems, clarifying ownership, and providing evidence for motor vehicle departments, lenders, and purchasers when resolving title discrepancies.

  • Individual vehicle owners resolving discharged liens with state motor vehicle departments.
  • Auto dealers clearing titles after loan payoff or trade-in transactions.
  • Financial institutions confirming lien releases to remove security interests for resale.

Common Preparation Mistakes to Avoid

  • Missing or incorrect VIN entries are a frequent cause of DMV rejection; always verify the full 17-character VIN against the vehicle title and physical VIN plate.
  • Failing to notarize when state law requires it can invalidate the affidavit; check jurisdictional notary rules before signing to avoid re-filing.
  • Using informal or unsigned payoff letters without lender signature often leads to disputes; obtain official release documentation directly from the lienholder.
  • Inaccurate party names, missing contact information, or typographical errors can create chain-of-title problems and increase the time to clear a title.
