What a Topography Services Agreement Covers

A Topography Services Agreement is a written contract that defines the scope, standards, schedule, deliverables, access and payment terms for a land surveyor or surveying firm that will produce topographic mapping and related survey products. Typical elements include a description of the site, coordinate system and datum, survey methods (field control, GPS, total station), deliverable formats (paper map, CAD, GIS, contour intervals), required professional stamps or certifications, timeline for field work and delivery, client responsibilities for site access, and insurance and indemnity provisions to allocate risk.

Why a Formal Agreement Matters

Using a clear Topography Services Agreement reduces scope disputes, defines liability and insurance requirements, sets delivery and payment expectations, and creates an audit trail for permitting, design, and recording purposes under state law.

Why a Formal Agreement Matters

Who Typically Prepares and Signs This Agreement

The agreement clarifies responsibilities between the surveyor, the client, and any third-party reviewers or recording authorities.

  • Real estate developers and brokers who need accurate site data for acquisition and disclosure purposes.
  • General contractors and civil engineers who require contours, spot elevations, and utility locations for design and bids.
  • Government agencies and public-works departments commissioning surveys for public projects or permitting.

Core Clauses to Include in a Professional Agreement

A complete Topography Services Agreement organizes obligations, measurable standards, and administrative items so both parties know deliverables, timing, and remedies.

Scope of Work

Precisely list survey limits, feature types to be mapped, contour intervals, and any excluded tasks such as subsurface utility investigation; avoid vague phrasing to prevent scope creep and disputes.

Deliverables

Specify formats (paper, PDF, CAD DWG, GIS shapefiles), coordinate reference system and datum, projection details, layer naming conventions, and the number of hard copies or digital revisions included.

Site Access

State who provides access and permission, timing windows for field work, requirements for utilities locates, and any costs or delays caused by denied or late access.

Survey Standards

Reference the professional standard of care, applicable state survey standards, accuracy tolerances, control point requirements, and certification or stamp obligations for recordation.

Payment Terms

Define fixed price or hourly billing, milestone payments, invoicing cycles, late payment interest, and responsibilities for change-order costs or additional fieldwork.

Liability & Insurance

Allocate responsibility for errors, require professional liability and general liability insurance limits, and include indemnity language and limits on consequential damages where permissible.

Essential Information to Provide

Client Legal Name: Exact legal entity name
Property Address: Street, city, state, ZIP
Parcel / APN: Parcel ID or assessor number
Coordinate Datum: NAD83, NAD27, WGS84, etc.
Access Instructions: Gates, contact, hours
Primary Contact: Name, phone, email

Step-by-Step: Completing the Agreement

Follow this sequence to assemble, approve, and execute a Topography Services Agreement with minimal delay.

  • 01
Draft the Scope: Describe site limits, features, and exclusions in plain terms.
  • 02
Confirm Schedule: Set fieldwork and delivery dates, and contingency windows.
  • 03
Agree Fees: Document fees, milestone payments, and change-order process.
  • 04
Execute Signatures: Have authorized representatives sign and date the final document.

How to Configure a Digital Workflow for This Agreement

Set up a repeatable e-sign and delivery workflow that assigns roles, authentication, and output formats before sending the agreement for signature.

Field Configuration
Template Selection Use a versioned template to keep clauses consistent
Signer Roles Primary signer, witness, and approver as needed
Authentication Level Email link or two-factor authentication for higher assurance
Output Delivery Deliver final PDF and separate CAD/GIS files to stakeholders

Where to Send the Signed Agreement and Deliverables

Understand each destination for executed contracts and survey deliverables so records, design, and permitting stay aligned.

  • Client File: Signed agreement retained by client and surveyor
  • Project Team: Distribute drawings to engineers and contractors
  • Permitting Authority: Provide required surveys for permit applications
  • County Recorder: Record plats or easement documents where applicable

Digital Signing and Format Requirements

For e-signing and file exchange, use platforms that support PDF, DWG/DXF and common GIS formats and that provide a tamper-evident audit trail.

  • File Formats: PDF, DOCX, DWG, SHP supported
  • Integrations: Salesforce, NetSuite, Box, Procore
  • Security Standards: TLS in transit; AES-256 at rest

Typical Timelines and Deadlines to Track

Assign clear dates for fieldwork, review, payment, and recording to prevent project delays and cost escalation.

Effective Date:

Date parties sign the agreement

Fieldwork Window:

Range of dates when on-site survey will occur

Draft Delivery:

Date for initial deliverable submission

Final Delivery:

Date for final corrected files

Recording Deadline:

Date to record plats or easements if required

Common Preparation and Execution Errors

  • Vague site descriptions that omit corners, reference monuments, or parcel identifiers, creating ambiguity for survey boundaries and recordation.
  • Failure to specify coordinate datum and projection, which causes mismatched layers when GIS or CAD files are combined with other datasets.
  • Not defining who is responsible for utility locates and clearance, causing field delays and potential safety hazards.
  • Using unsigned or partially signed attachments (exhibits, maps) that reference the agreement but are not explicitly incorporated by reference.

Consequences of an Incorrect or Missing Agreement

Boundary Dispute: Costly litigation
Recording Rejection: Delayed permits
Contractual Gaps: Unpaid change orders
Insurance Exposure: Claim denials possible
Construction Delays: Increased project cost
Regulatory Fines: Agency penalties

Updating or Amending the Agreement

Follow a documented amendment process to preserve consent and avoid later disputes.

Identify Change:

Document specifics of the proposed amendment
02

Prepare Addendum:

Draft a short addendum referencing original agreement
03

Review Terms:

Confirm cost, schedule, and scope impacts
04

Sign Amendment:

05

Attach Exhibit:

Attach field notes or revised maps as exhibits
06

Distribute Copies:

Provide updated files to all stakeholders

Representative Use Cases

These scenarios show how a Topography Services Agreement is applied across common project types.

Subdivision Survey

A developer requests a boundary and topographic survey covering 20 acres to support preliminary platting

  • The scope includes two control points and one-foot contours
  • The executed agreement specifies deliverables as CAD and PDF, a three-week schedule, and payment milestones tied to draft and final submissions to the county planning office.

Roadway Improvement

A municipality contracts a firm for corridor topography ahead of design plans

  • The task requires ability to work on active roadways and traffic control coordination
  • The contract includes indemnity, prevailing wage notice, RON-capable signature for quick approvals, and GIS-ready outputs for the public-works asset system.
