WHEREAS, Claimant desires to elect the tort remedy and to set forth the terms on which Claimant will pursue third-party recovery and Respondent will assert or preserve subrogation or lien rights.

NOW THEREFORE, in consideration of the mutual covenants set forth below, the parties agree as follows:

1. ELECTION

Claimant hereby elects (select one or more as applicable):

2. ASSIGNMENT, LIEN, AND SUBROGATION

What the Tort Election Form Is and when it’s used

A Tort Election Form is a written statement used to trigger or record a claimant’s choice to pursue a tort-based remedy instead of an alternative remedy available under statute, contract, or administrative program. It documents the claimant’s election, identifies the parties and facts, and sets the election effective date. Many jurisdictions require a timely, clear election to preserve rights or to shift the administrative forum; the exact form and required fields vary by statute or program. Use the completed form to create a clear record for the defendant, insurer, and tribunal.

Why a clear Tort Election matters

A properly completed Tort Election Form preserves the claimant’s right to a tort remedy, starts relevant deadlines, and reduces disputes about procedural choice. Accurate elections limit ambiguity for insurers and opposing counsel and help avoid forfeiture of claims due to missed time windows.

Why a clear Tort Election matters

Who typically completes or receives this form

Confirm who must sign and whether the election requires filing with a court or agency; local counsel can confirm procedural effects in your jurisdiction.

  • Claimants filing a notice of claim or switching forum

  • Defense counsel confirming election for litigation strategy

Step-by-step: completing a Tort Election Form

Follow these steps in order to reduce errors and ensure the election is effective under applicable rules.

  • 01
Gather documents: Collect ID, policy numbers, and the underlying incident record.
  • 02
Choose election: Confirm you intend to pursue tort remedies rather than alternatives.
  • 03
Complete fields: Enter names, dates, jurisdiction, and facts clearly and legibly.
  • 04
Sign and file: Have authorized signers execute and submit to required parties.

Common preparation mistakes to avoid

  • Unclear election language that fails to state the chosen remedy explicitly, creating room for opposing counsel to argue ambiguity and delay resolution.
  • Signing with an incorrect party name or title, which can invalidate the election where identity and authority are contested during litigation.
  • Missing or inconsistent effective dates that cause disputes about when rights or deadlines began to run, potentially leading to dismissed claims.
  • Failing to check jurisdictional filing rules (court vs administrative agency) and missing required filing methods or attachments specific to the governing statute.

How the election process typically flows

A clear flow reduces processing time and avoids misrouting; the following shows a common path from completion to enforcement.

  • Prepare form: Populate required fields and attach evidence.
  • Execute: Authorized signer signs and dates the form.
