TOUR BOOKING FORM AND SERVICE AGREEMENT

Parties and Recitals

WHEREAS, Client Name: (the "Client") desires to engage certain tour services as described below; and

WHEREAS, Tour Operator Name: (the "Operator") agrees to provide such services under the terms and conditions set forth in this Agreement; and

WHEREAS, Effective Date: , the parties enter into this Tour Booking Form and Service Agreement to record the scope, payment terms, cancellation rights, and other material provisions governing the tour services.

Participant Information

Scope of Work

The Operator shall provide the Client with guided tour services, transportation where specified, and any ancillary services expressly set forth below. Services include itinerary planning, on-tour guide services, vehicle and driver as applicable, and coordination of booked activities. Specific services to be provided are described by the parties as follows:

Payment Terms

Total Tour Price (including all fees and standard taxes): $

Late Payment: If any payment is not received by the due date, the Client shall pay a late fee of of the overdue amount per billing cycle until paid in full. The Operator may suspend services for overdue accounts after providing written notice.

Cancellation, Refunds and Termination

Cancellation Policy: Cancellations by the Client must be provided in writing to the Operator. If a cancellation is received more than days prior to the scheduled tour date, the deposit will be refunded minus administrative fees of . Cancellations received within the cancellation notice period will forfeit the deposit and may be subject to additional cancellation fees up to the full tour price.

Termination for Cause: Either party may terminate this Agreement for material breach by the other party if such breach is not cured within days after written notice. Termination does not relieve the Client of obligations to pay for services already rendered or non-refundable expenses incurred on the Client’s behalf.

Assumption of Risk and Liability

The Client acknowledges that participation in tours involves inherent risks, including but not limited to bodily injury, property damage, delays, and acts of third parties. The Client assumes all such risks and agrees that the Operator's liability for any claim arising out of this Agreement shall be limited to direct damages not exceeding the total fees paid by the Client for the affected portion of services, and the Operator shall have no liability for incidental, consequential, or punitive damages. The Client agrees to indemnify and hold the Operator harmless from claims arising from the Client's negligence or willful misconduct.

Confidentiality

Each party shall treat as confidential and shall not disclose to any third party any non-public business or personal information obtained from the other party in connection with this Agreement, except as required by law or necessary to perform the services. Confidential information excludes information that is or becomes publicly available through no breach of this Agreement or that is independently developed by the receiving party.

Term

This Agreement commences on Start Date: and shall expire on End Date: , unless earlier terminated in accordance with the Termination provisions above.

Governing Law; Entire Agreement

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the State of , without regard to conflict of law principles.
