What the Touring Services Management Agreement Is

A Touring Services Management Agreement is a written contract that sets out the responsibilities, payment terms, schedules, and deliverables between an artist, their touring manager, and other tour stakeholders such as promoters or production companies. It defines the scope of services provided during a tour, staffing and on-site obligations, expense reimbursement, insurance and indemnity, cancellation and force majeure procedures, and the process for resolving disputes. The document clarifies timing and milestones for deposits, final payments, and technical riders to reduce misunderstandings across multiple venues and jurisdictions.

Why Parties Use a Touring Services Management Agreement

This agreement creates certainty about roles, fees, expenses, and risk allocation during a tour. It reduces disputes by documenting schedules, payment triggers, cancellation remedies, and insurance responsibilities while preserving evidence required for legal or tax purposes.

Why Parties Use a Touring Services Management Agreement

Who Typically Prepares and Signs This Agreement

Several parties rely on a Touring Services Management Agreement to coordinate tour execution and finances.

  • Artist management teams coordinating logistics and payments across markets.
  • Promoters or venue operators agreeing performance dates, technical needs, and payment schedules.
  • Touring managers or production companies delivering services and staffing for each show.

Clear role definitions in the agreement reduce disputes and aid timely payments and compliance across states.

Key Signer Roles

Artist Manager — Typically signs on behalf of the artist or artist entity and certifies authority to commit to fees, schedules, rider requirements, and reimbursement terms. The manager often coordinates with promoters and production teams to confirm dates and technical needs.

Tour Promoter

Promoter / Venue Representative — Signs to confirm engagement, payment schedule, and venue responsibilities such as security, load-in time, and local permits. Promoter signature confirms agreement to indemnity, cancellation terms, and any local licensing requirements.

Core Sections to Include in a Professional Agreement

A comprehensive Touring Services Management Agreement addresses operational, financial, and legal matters so all parties understand expectations and remedies.

Scope of Services

Describe specific duties such as artist travel coordination, crew staffing, soundcheck procedures, and venue liaison responsibilities. Be explicit about which services are included and which are out-of-scope to avoid billing disputes.

Payment and Fees

Set the fee structure, deposit amount, final payment timing, accepted payment methods, late fees, and any profit-sharing or guarantees. Tie payments to deliverables or dates to create objective triggers.

Expense Reimbursement

Define covered expenses, per-diem rates, approval thresholds, reimbursement timing, and documentation required (receipts, expense report formats) to ensure predictable accounting.

Cancellations & Force Majeure

Specify cancellation windows, force majeure scope, notice requirements, and which deposits or fees are refundable versus forfeitable to minimize contention after an unforeseen event.

Insurance & Indemnity

Require insurance types and limits (general liability, workers’ comp, event cancellation) and allocate indemnity obligations for third-party claims and damage to property or persons.

Term, Termination, & Dispute Resolution

State the agreement term, termination rights, notice periods, and dispute resolution method such as mediation or arbitration and the governing law for interpretation.
