What the Trademark Drawing Submission Form Is

The Trademark Drawing Submission Form records the visual representation of a trademark submitted to the United States Patent and Trademark Office (USPTO) as part of an application or amendment. It specifies whether the mark is a standard character mark or a design mark, identifies color claims, and links the drawing to the goods or services in the filing. Accurate drawings determine the scope of protection, affect examination outcomes, and must meet USPTO technical requirements for file format, resolution, and reproducibility.

Why a Clear Drawing Matters for Your Mark

A compliant drawing reduces the risk of office actions and abandonment, clarifies the mark's scope, and supports enforcement. Clear, correctly formatted drawings help examiners assess distinctiveness and help courts or third parties compare alleged infringements against the registered mark.

Why a Clear Drawing Matters for Your Mark

Who Typically Prepares a Trademark Drawing

Several roles commonly prepare or authorize the drawing submission depending on organizational size and legal support.

  • Trademark attorneys and agents — prepare compliant drawings, draft descriptions, and handle USPTO correspondence.
  • Brand managers and marketing teams — supply accurate artwork, color specifications, and intended use details.
  • Paralegals and IP coordinators — assemble files, confirm formats, and upload documents through the USPTO TEAS system.

Collaboration between legal and creative teams reduces technical errors and ensures the drawing matches how the mark is used in commerce.

Primary Signatories and Roles

Trademark Attorney

A licensed attorney or registered USPTO practitioner signs filings when acting on behalf of an applicant. They confirm accuracy, select filing basis, and manage Office Action responses and specimen alignment with the drawing.

Brand Manager

An in-house brand owner or marketing lead supplies the final artwork and color specifications, confirms intended commercial use, and authorizes submission when no outside counsel is engaged.

Core Parts of a Professional Drawing Submission

A proper submission combines technical image files with clear metadata so the USPTO examiner can reproduce and evaluate the mark.

Mark Image

High-resolution artwork in an accepted format showing the exact design or standard-character representation. The image must be reproducible and match the specimen and description.

Mark Description

A concise, objective statement describing the mark's elements, placement, and stylization. Avoid marketing language; describe only visual elements that affect registrability.

Filing Basis

Identification of the legal basis for registration (use in commerce, intent-to-use, foreign registration, etc.) because drawings can differ by use and specimen.

Color Claim

If color is claimed, specify each color and whether the mark is limited to those colors. Provide a black-and-white reproducible drawing if required by the USPTO rules.

Specimen Linkage

Reference or attach the specimen that shows actual use. Ensure the specimen demonstrates the mark as it appears on goods or in advertising channels.

Owner Information

Accurate applicant name, entity type, and address must match the ownership record; mismatches can cause formal refusals or require rectifying amendments.

Owner Name: Exact legal name
Mark Drawing: Accepted image format
Filing Basis: Use or intent-to-use

Step-by-Step: Completing the Drawing Submission

A clear sequence helps avoid preventable refusals and reduces USPTO back-and-forth.

  • 01
Prepare Artwork: Create a high-resolution, reproducible image.
  • 02
Draft Description: Write a factual, non-promotional description.
  • 03

Typical Digital Workflow Configuration

Common configuration settings help standardize submissions and reduce rework.

Color Handling Separate color claim field
Audit Trail Enable timestamps and user IDs

How the Drawing Submission Route Typically Flows

The filing process moves from artwork preparation to USPTO receipt and examiner review.

  • Prepare Drawing: Create compliant artwork
  • Attach to Application: Upload via TEAS or e-filing portal
  • USPTO Review: Examiner checks formalities
  • Office Action or Registration: Respond to issues or proceed to publish

Technical and Platform Considerations for eSubmission

Use platforms that accept USPTO-compatible file formats, preserve image fidelity, and capture a verifiable audit trail.

  • File Formats: PDF, PNG, TIFF
  • Integrations: Works with common storage and CMS
  • Authentication: Email or multifactor options

Confirm your chosen service preserves original files, records signer identity, and retains submission metadata for recordkeeping and potential enforcement.

Key Filing and Post-Filing Deadlines to Watch

Timely responses and maintenance filings preserve rights and avoid abandonment or cancellation.

Application Filing Date:

Establishes priority for the mark

Common Preparation Errors to Avoid

  • Submitting low-resolution or compressed artwork that obscures details and triggers formal refusal.
  • Claiming color without a matching color drawing or failing to provide a reproducible black-and-white version.
  • Describing the mark with promotional or ambiguous language rather than precise visual elements.
  • Uploading a specimen that does not show the mark exactly as represented in the drawing.

Consequences of Incorrect Drawing Submissions

Office Action: Formal refusal possible
Abandonment: Failure to respond risks abandonment
Narrowed Scope: Limitations on protection
Fee Loss: Filing fees typically nonrefundable
Enforcement Risk: Weaker infringement claims
Refile Delay: Correcting issues can delay rights
