TRAMPOLINE PARK LIABILITY WAIVER

RECITALS

WHEREAS, the Trampoline Park Operator operates an indoor recreational facility offering trampoline-based activities, parties, classes, and related services; and

WHEREAS, the Participant desires to engage in activities at the facility and acknowledges that such activities involve inherent risks of physical injury; and

WHEREAS, the parties intend by this Waiver to set forth the terms under which the Participant will be permitted to participate in trampoline activities and related services.

PARTICIPANT INFORMATION

SCOPE OF ACTIVITIES

The Participant will engage in the following activities at the facility. The Operator may provide supervision, instruction, or supervised open-jump sessions as indicated below.

ASSUMPTION OF RISK, RELEASE, AND INDEMNIFICATION

I, the undersigned Participant (or Parent/Guardian signing on behalf of Participant), acknowledge that trampoline activities are inherently hazardous and can result in serious injury or death. I voluntarily assume all risks, known and unknown, arising from participation in the activities described above, whether arising from the negligence of the Operator or otherwise.

In consideration for being permitted to participate, I release, waive, discharge, and covenant not to sue the Operator, its owners, officers, employees, agents, and affiliates from any and all liability, claims, demands, or causes of action for injury, loss, or damage to myself or my property, including claims based on negligence, breach of warranty, or strict liability. I further agree to indemnify and hold harmless the Operator from any claims, damages, or costs, including attorney fees, arising out of or related to my participation.

MEDICAL CONSENT AND PHOTO RELEASE

I authorize the Operator to obtain emergency medical treatment for the Participant if I am not immediately available. I understand I am responsible for all costs associated with emergency medical care.

I grant the Operator permission to photograph and record the Participant during activities and to use such images or recordings for promotional, educational, or operational purposes without compensation, unless prohibited by law.

PAYMENT TERMS

Participant agrees to pay the Operator the fees specified for admission, rentals, classes, or party services as listed below.

TERM AND TERMINATION

This Waiver is effective for participation on the date(s) identified below and continues for the stated term unless earlier terminated as set forth herein.

CONFIDENTIALITY

The parties agree that any non-public business information exchanged between them in connection with private lessons, coaching programs, or corporate events shall be treated as confidential and shall not be disclosed to third parties without the prior written consent of the disclosing party, except as required by law.

GOVERNING LAW

This Waiver shall be governed by and construed in accordance with the laws of the State of , without regard to its conflict-of-law principles. Any action arising out of this Waiver shall be brought in the state or federal courts located in that state.

ENTIRE AGREEMENT

This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether written or oral. No amendment shall be effective unless in writing and signed by both parties.

SEVERABILITY

If any provision of this Waiver is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
