What the Transfer Case Document Is and When it Applies

A Transfer Case Document records the authorized transfer of a legal matter, client file, or administrative case from one party, office, or jurisdiction to another. It documents identities, scope of the transfer, dates, and any limitations or retained responsibilities, and creates a clear chain of custody for files, evidence, or client records to reduce disputes and ensure continuity of representation or service.

Why a Formal Transfer Case Document Matters

Using a structured Transfer Case Document clarifies scope, prevents misunderstandings about duties and deadlines, and preserves evidence of consent or authority. The document is enforceable electronically under federal law (15 U.S.C. ch. 96, ESIGN) and state UETA frameworks where applicable, subject to statutory exceptions such as certain court filings.

Why a Formal Transfer Case Document Matters

Who typically completes and signs this document

Common users complete the Transfer Case Document to move custody or responsibility for a matter while creating a verifiable record.

  • Transferring Attorney or Law Firm — Attorneys transferring a client file or case to another counsel after conflict check or client request.
  • Institutional Custodian — Hospitals, clinics, or government offices transferring records between departments or to an external provider.
  • Client / Authorized Representative — Clients or their authorized agents who must consent to transfer of their file or representation.

Each signer should confirm identity and authority; when records are sensitive, add HIPAA or confidentiality language as required.
