What the Transportation Land Haul Agreement Is and When It Applies

A Transportation Land Haul Agreement is a contract between a shipper and a land carrier that sets the terms for moving goods by truck or other ground transportation. It defines services, routing, delivery windows, rates, payment terms, freight classification, liability limits, insurance requirements, and claims procedures. The agreement clarifies responsibilities for loading, unloading, detention, layovers, and accessorial charges, and it establishes the governing law, term, and signature blocks for both parties to accept operational and commercial obligations.

Why a Clear, Written Land Haul Agreement Matters

A written Transportation Land Haul Agreement reduces disputes by documenting service scope, payment rules, and liability allocations. It streamlines operations, clarifies insurance and claims handling, and creates an enforceable record for carriers, shippers, and brokers under applicable law such as ESIGN and UETA when signed electronically.

Why a Clear, Written Land Haul Agreement Matters

Who Typically Completes This Agreement

The Transportation Land Haul Agreement is used by organizations involved in shipping, receiving, and moving freight across land routes.

  • National carriers and regional trucking companies managing lane contracts and fleet operations
  • Shippers and logistics teams contracting recurring pickup and delivery services for inventory or project freight
  • Third-party logistics providers and brokers arranging transport and needing documented rate and liability terms

Use this agreement when formalizing recurring lanes, contract rates, one-off project hauls, or when carriers and shippers need a consistent claims and liability framework.

Primary Signers

Carrier Representative

Fleet manager or authorized officer who provides the carrier's legal name, MC/DOT numbers, insurance certificates, and acceptance of operational terms; signs to assume carrier duties and liabilities under the agreement.

Shipper Representative

Logistics manager or purchasing officer authorized to bind the shipper; enters pickup/delivery requirements, commodity descriptions, and payment account details and signs to accept freight charges and claims procedures.

Key Sections to Include in a Professional Land Haul Agreement

A complete Transportation Land Haul Agreement organizes obligations into standard sections so parties can find commercial, operational, and legal terms quickly.

Parties

Full legal names, addresses, carrier MC/DOT numbers, and contact details for shipper and carrier so the agreement clearly identifies who is bound by the terms and who receives notices.

Scope of Services

Detailed description of the shipment types, handling requirements, pickup and delivery instructions, routing constraints, and any special equipment needed to avoid ambiguity at tender and execution.

Rates and Payment

Pricing structure, fuel surcharges, accessorial charges, invoicing intervals, payment terms, and late-payment remedies to avoid disputes over freight bills and settlements.

Liability and Insurance

Limits of liability, required insurance coverages and minimum policy amounts, cargo valuation rules, and evidence of insurance to protect both parties in loss or damage events.

Claims and Dispute Resolution

Notice periods for loss or damage claims, documentation required, timelines for investigation, and the chosen dispute resolution method such as arbitration or court venue.

Termination and Indemnities

Grounds for early termination, cure periods, indemnity clauses, and allocation of consequential damages to manage the commercial and legal exit from the relationship.
