What the Transportation Taxi Ferry Agreement Is and When It’s Used

A Transportation Taxi Ferry Agreement is a written contract that defines the rights, duties, fares, schedules, transfer procedures, and liability allocation between parties involved in combined taxi and ferry transport services. It can be used between operators, between an operator and a municipal authority, or between a carrier and a commercial client to document routing, boarding and disembarkation points, passenger transfers, service interruptions, emergency procedures, insurance minimums, and payment terms. Where permitted, the agreement can be executed electronically in compliance with the ESIGN Act (15 U.S.C. ch. 96) and state UETA statutes for enforceability across jurisdictions.

Why a Formal Agreement Matters for Taxi–Ferry Operations

A clear Transportation Taxi Ferry Agreement reduces operational ambiguity, allocates risk, documents insurance and safety obligations, and creates an auditable record for regulators and insurers. It also helps standardize passenger terms, claim handling, and transfer liability between modes.

Why a Formal Agreement Matters for Taxi–Ferry Operations

Who Typically Prepares and Signs These Agreements

The agreement is used by public and private transport stakeholders who coordinate multi-modal passenger services.

  • Municipal transit agencies and harbor authorities coordinating scheduled ferry-taxi transfers and regulatory oversight.
  • Private taxi and ferry operators contracting for shared-ticketing, last-mile pickup, or dedicated shuttle connections.
  • Commercial clients (hotels, tour operators) arranging bundled passenger transport services and liability allocation.

Parties should ensure signatory authority and contact details are current before execution.

Primary Signatories and Typical Roles

Fleet Manager

Fleet managers or operations directors sign on behalf of carriers to confirm service obligations, incident reporting procedures, driver qualifications, and insurance certificates. They ensure schedules and transfer points in the agreement match operational routes and timetables.

Harbor Counsel

Legal counsel for a harbor authority or municipal transportation department signs or approves change clauses, indemnities, and regulatory compliance language, ensuring the agreement aligns with local ordinances and public safety requirements.

Core Elements to Include in a Professional Agreement

A comprehensive Transportation Taxi Ferry Agreement should cover operational, financial, insurance, and dispute-resolution terms so both parties have predictable duties and remedies.

Service Scope

Define exact routes, pickup/drop-off points, frequency, and conditions for service suspension or rerouting due to weather or port restrictions.

Fare & Payment

Set fare structure, accepted payment methods, billing cycles, refund policies, and responsibilities for third‑party ticket sales or commissions.

Liability & Insurance

Specify minimum insurance limits, naming of additional insureds, indemnity allocation, and notice procedures for claims or accidents.

Scheduling & Dispatch

Detail dispatch responsibilities, hold times, communication channels, delay notifications, and obligations for standby or surge capacity.

Transfer Procedures

Describe passenger transfer protocols between taxi and ferry, boarding priority, luggage handling, and crew responsibilities during transfers.

Amendments & Termination

State notice requirements for amendments, termination triggers, cure periods, and the process for handling ongoing reservations upon termination.
