Recitals

WHEREAS, Participant desires to participate in travel services, arrangements, excursions or related activities organized, arranged or provided by Provider; and

WHEREAS, Participant acknowledges the inherent risks of travel, including but not limited to transportation incidents, changes in itinerary, medical events, and acts of third parties, and agrees to the terms set forth in this Travel Liability Waiver in consideration of Provider permitting Participant to join the travel program.

Assumption of Risk and Waiver of Liability

Participant understands and expressly acknowledges that participation in travel and related activities involves inherent risks, including injury, illness, disability, death, property loss, and other damages. Participant voluntarily assumes all risks, whether known or unknown, foreseeable or unforeseeable. Participant hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Provider and its agents, employees, contractors, representatives and insurers (collectively, the Released Parties) from any and all liability, claims, demands, actions or causes of action arising out of or related to any loss, damage, injury or death that may be sustained by Participant arising out of or in connection with the travel services, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by applicable law.

Participant further agrees to defend, indemnify and hold harmless the Released Parties from and against any claims, liabilities, losses, costs or expenses (including reasonable attorneys' fees) arising out of Participant's acts, omissions, breach of this agreement, or failure to follow safety instructions.

Medical Authorization and Health Information

Participant must disclose all material medical conditions. Participant authorizes Provider to obtain emergency medical treatment for Participant if deemed necessary and agrees to be financially responsible for such treatment.

I authorize Provider to arrange or consent to emergency medical treatment for me if I am incapacitated or otherwise unable to consent, and I agree to be responsible for all costs incurred.

Fees and Payment Terms

Participant agrees to pay fees as set forth below. Failure to timely pay may result in cancellation of travel arrangements and forfeiture of deposits.

This Agreement is effective as of the date Participant signs below and continues through the completion of the travel services unless earlier terminated in accordance with this section.

Confidentiality and Data Use

Provider will use Participant's personal and health information only as reasonably necessary to provide travel services, arrange emergency care, or comply with legal obligations. Provider will not disclose Participant's sensitive personal data to third parties except as required to provide services, as required by law, or with Participant's consent.

Governing Law; Entire Agreement; Severability

This Agreement shall be governed by and construed in accordance with the laws of the state of , without regard to conflict of laws principles. If any provision is held invalid, the remaining provisions shall remain in full force and effect.
