WHEREAS

WHEREAS, Client has requested that Tour Operator arrange and provide the travel services described in this form, including but not limited to transportation, accommodation, guided activities, and related services (the "Services"); and

WHEREAS, Tour Operator has represented that it is duly authorized and qualified to arrange such Services and agrees to provide the Services in accordance with the terms and conditions set forth herein; and

WHEREAS, the parties desire to set forth the terms of the booking and the obligations of each party in writing.

Scope of Work

The Tour Operator will provide the Services described below, subject to availability and the terms of this Booking Form. Services may include transportation, accommodations, guides, entrance fees, meals explicitly stated in the itinerary, and other specified arrangements.

Payment Terms

Client agrees to pay the total booking price specified below in accordance with the schedule. All monetary amounts are stated in the currency agreed by the parties.

All payments not received by the Balance Due Date may incur the Late Payment Fee and permit Tour Operator to suspend services or cancel the booking in accordance with the Cancellation and Refund provisions below. Deposits are non-refundable except as expressly stated otherwise in writing.

Cancellation and Refund Policy

Cancellation by Client must be delivered in writing. Cancellation charges will be applied as follows: if cancellation occurs more than 60 days prior to departure, the deposit is forfeited; if cancellation occurs 30–60 days prior to departure, 50% of the Total Tour Price is due; if cancellation occurs less than 30 days prior to departure, 100% of the Total Tour Price is due. Additional supplier-imposed fees may apply and are the responsibility of Client. Tour Operator will make reasonable efforts to mitigate losses.

Either party may terminate this Agreement for material breach by the other party if the breach is not cured within days after written notice. Tour Operator may terminate immediately for non-payment or if suppliers cancel contracted services. Termination does not relieve Client of liability for amounts owed for Services performed or irrecoverable supplier costs.

Confidentiality

Each party agrees to keep confidential and not disclose any non-public business, financial, or personal information of the other party obtained in connection with this Booking Form, except as required to perform the Services, to comply with legal obligations, or with the prior written consent of the disclosing party. Confidential information does not include information that is or becomes publicly available through no fault of the receiving party.

Liability, Assumption of Risk and Insurance

Client acknowledges that travel involves inherent risks, including but not limited to injury, illness, property loss, and delays. To the fullest extent permitted by law, Tour Operator's liability for loss, damage or injury is limited to the amount actually paid by Client for the Services giving rise to the claim, and Tour Operator is not liable for indirect or consequential damages. Client is strongly advised to obtain comprehensive travel insurance covering medical, evacuation, trip cancellation and interruption.

Governing Law

This Booking Form and any dispute arising out of or in connection with it shall be governed by the laws of the state or jurisdiction identified below, without regard to its conflict of law principles.

Entire Agreement

This Booking Form, including any attachments, confirmations and supplier vouchers issued pursuant to it, constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior negotiations, communications and agreements, whether written or oral. Any modification must be in writing and signed by both parties.
