What a Tree Cutting Agreement Covers

A Tree Cutting Agreement is a written contract that documents the terms under which one party will remove, trim, or otherwise dispose of trees on property owned by another party. It defines scope of work, access rights, timelines, payment or consideration, liability and insurance expectations, and post‑work cleanup. For projects near property lines or utility easements the agreement clarifies responsibility for permits, neighbor notifications, and damage repairs. Clear written terms reduce disputes and provide a record for contractors, property owners, insurers, and local authorities.

Why use a formal Tree Cutting Agreement

A written agreement allocates risk, documents permission to access private property, and sets binding expectations on scope, timing, and cost so both parties understand responsibilities.

Why use a formal Tree Cutting Agreement

Who typically completes a Tree Cutting Agreement

Common participants include property owners, commercial/residential contractors, utility companies, and homeowners associations.

  • Property owner — details the parcel, authorizes access, and confirms payment arrangements
  • Licensed arborist/contractor — lists services, proof of insurance, license number, and scheduled start/completion dates
  • HOA or municipality representative — documents approval conditions and any permit requirements

Use signatures from all listed parties to document consent and create an enforceable record.

Essential clauses to include in a professional agreement

A complete agreement balances clarity and legal protection while remaining practical for the specific site and job scale.

Scope and exclusions

Precisely describe work to be performed and list excluded work (for example, root excavation or stump chemical treatment) to avoid disputes.

Access and timing

Grant access rights, set work hours, specify start/completion windows, and require advanced notice for schedule changes.

Payment terms

State deposit amounts, progress payments, final payment conditions, and consequences for late payment or cancellation.

Liability and insurance

Require contractor liability insurance limits, name the owner as additional insured if required, and include indemnity language.

Permits and compliance

Assign responsibility for obtaining permits, meeting municipal ordinances, and arranging any required utility clearances.

Cleanup and disposal

Specify debris removal, stump disposal or grinding, and site restoration obligations upon completion.

Key legal and compliance items to document

Insurance: Liability limits and provider
Permits: Permit numbers and issuing agency
WCB/Workers Comp: Proof of coverage for crew
Indemnity: Contractor indemnification clause
Property access: Written access authorization
Completion date: Specified final work date

Common penalties and legal risks to avoid

Municipal fines: Violation of local tree ordinances
Property damage: Liability for neighbor or owner loss
Unauthorized access: Trespass claims and injunctions
Permit violations: Stop-work orders and fines
Insurance gaps: Uncovered claims due to missing coverage
Contract disputes: Payment withholding and litigation

Frequent preparation mistakes

  • Vague scope descriptions that fail to identify which trees or parts of trees are included, leading to differing expectations and disputes.
  • Missing or expired insurance certificates, which can leave property owners exposed to claims and contractors personally liable for damages.
  • Failing to confirm utility locates or permits, causing project delays, fines, or significant safety hazards when equipment strikes buried lines.
  • Not documenting access rights or neighbor consent when work affects shared property, creating trespass and nuisance claims.

Typical workflow from agreement to completion

A mapped process ensures permits, insurance, and scheduling are verified before crews start on site.

  • Document: Draft and agree scope.
  • Confirm: Verify insurance and permits.
  • Perform: Contractor completes work.
  • Closeout: Cleanup, inspection, final payment.
