What the Tree Planting Additional Trees addendum covers

The Tree Planting Additional Trees addendum documents an agreement to supply, plant, and maintain one or more additional trees beyond those specified in an original tree planting contract or landscape plan. It records the species, size, planting locations, planting and post-planting care responsibilities, pricing or credits, scheduling, and any warranty or replacement terms. The addendum attaches to the primary contract and clarifies who pays for permits, irrigation adjustments, and ongoing maintenance, reducing disputes by creating a clear written record of scope and responsibilities for both landowner and contractor.

Why add an addendum for additional trees

Use the Tree Planting Additional Trees addendum to document changes without renegotiating the entire contract. It creates explicit scope, pricing, timing, and warranty terms for added trees, limits dispute risk, and provides a concise record for permits, maintenance obligations, and insurance.

Why add an addendum for additional trees

Who typically prepares or signs this addendum

Typical users who prepare or sign a Tree Planting Additional Trees addendum include the contractor, property owner, and project manager.

  • Landscape and nursery contractors who supply, plant, and warranty additional trees on private or commercial projects.
  • Homeowners, HOAs, and property managers ordering extra trees or authorizing replacements under an existing landscaping agreement.
  • Municipalities, parks departments, and developers adding trees to public rights-of-way or subdivision common areas.

Confirm signatory authority and any permit approvals are attached before finalizing and circulating the addendum.

Core components to include in a professional addendum

A professional Tree Planting Additional Trees addendum is structured to integrate with the original contract and clearly define technical, commercial, and legal responsibilities for added plantings.

Parties

Identify all contracting parties with legal names and contact details; include the primary contract reference, effective date, and a short recital explaining why additional trees are being added.

Tree Description

Provide species (common and botanical names), minimum size and caliper, root type, nursery grade, and any substitution rules; clarify acceptable variances and inspection standards on delivery.

Location

Attach or reference a site plan with addresses, GPS coordinates, planting bed IDs, and proximity to structures or utilities; require locate-before-dig checks when applicable.

Pricing & Payment

Specify unit prices, total cost, deposit requirements, payment schedule, change-order procedures, and responsibility for unexpected costs such as irrigation adjustments or soil import.

Schedule

Set target planting dates, weather windows, notice periods, and acceptance criteria for completed work; include remedies for missed milestones or unacceptable plant establishment.

Warranties & Care

Define warranty length, replacement conditions, maintenance obligations, irrigation responsibilities, and post-planting inspection intervals; specify who bears the cost of replacements.

Billing Disputes: Ambiguous quantities cause invoicing errors
Utility Damage Risk: Incorrect location may hit utilities
Notary Noncompliance: Failing state notary rules risks invalidation

Common preparation mistakes to avoid

  • Failing to attach or reference the original contract can create ambiguity about which terms the addendum modifies and may lead to enforcement disputes.
  • Using informal descriptions for planting locations instead of GPS or site-plan references leads to misplaced trees and potential utility conflicts with added costs.
  • Listing quantities in words rather than digits or omitting multi-stem notation causes billing mismatches and inventory problems at the nursery.
  • Neglecting to state who secures permits or pays inspection fees can delay planting and expose parties to municipal penalties.

Practical best practices for accurate completion

Practical, field-tested guidance to reduce errors and ensure enforceability when preparing and executing the Tree Planting Additional Trees addendum.

Confirm who secures permits and pays fees early
Identify which party files permit applications, pays associated fees, and handles inspection scheduling. Document timelines, approval contingencies, and any municipal conditions; unclear permit allocation is a frequent cause of planting delays and municipal fines.
Use precise planting locations with GPS or plan references
Provide street addresses, GPS coordinates, and planting bed identifiers; include scaled site plans. Precise references prevent misplacement, reduce utility strike risk, and ensure vendors meet placement obligations described in the addendum.
Specify acceptance tests, survival thresholds, and inspection timing
Define inspection dates, acceptable survival rates, replacement thresholds, and remedial actions for failed specimens. Clear acceptance criteria avoid subjective disputes about plant health and establish when warranty obligations begin or replacements are due.
Document responsibility for unexpected costs like soil, irrigation, or delays
State whether owner, contractor, or a shared cost model covers extras such as soil amendments, irrigation tie-ins, regrading, or extended crew time. Explicit change-order procedures minimize disputes and provide a traceable billing path for additional work.

Real-world scenarios using an addendum

Real examples of how parties used a Tree Planting Additional Trees addendum to clarify scope and avoid disputes during landscape projects.

Residential Replacement

A homeowner added three replacement trees after a storm and used an addendum to document species, placement, and cost adjustments tied to the original landscaping contract.

  • Defined species, GPS locations, and a prorated price.
  • The clear written addendum prevented billing disputes when the nursery substituted a closely related cultivar and allowed the homeowner to approve a revised cost estimate before planting, avoiding delays and preserving the contractor warranty for the new specimens.

Municipal Planting

A parks department expanded a street-tree program and issued addenda to multiple planting contracts to standardize species, inspection checkpoints, and maintenance responsibilities across suppliers.

  • Standardized inspections and replacement terms reduced disputes.
  • Using uniform addenda enabled the city to aggregate warranty obligations, require consistent locate-before-dig protocols, and compare vendor pricing directly; the standardized approach shortened procurement cycles and simplified post-installation tracking for urban canopy management.
