Scope of Addition

Payment Terms

In consideration for accepting the addition and for administrative services, the Adding Party shall pay the Trustee as follows.

All payments due under this document shall be made to the Trustee in cleared funds. If any payment is not made when due, the Trustee may suspend acceptance or administration of the addition pending cure and shall be entitled to recover reasonable costs and expenses incurred as a result.

Term and Termination

This addition shall become effective on the Effective Date specified above and shall continue in effect until terminated in accordance with this section or the terms of the trust instrument.

Confidentiality

The parties acknowledge that information exchanged in connection with this addition may be confidential. The Trustee and the Adding Party agree to treat nonpublic information relating to the trust, the trust beneficiaries, and the property being added as confidential and not to disclose such information except (a) to their respective legal, tax or financial advisors who have a need to know and are bound by confidentiality obligations, (b) as required by law or court order, or (c) as necessary to administer the trust. Confidential information does not include information that is or becomes publicly available other than by breach of this document.

Representations and Warranties

The Adding Party represents and warrants that they have the full legal capacity and authority to add the described asset, interest, or beneficiary to the trust; that the property is free and clear of liens and encumbrances except as disclosed in writing; and that any statements made herein are true and correct. The Trustee represents that it has authority under the trust instrument to accept and administer the addition consistent with fiduciary duties.

Governing Law

This document and any dispute arising out of or related to it shall be governed by and construed in accordance with the laws of the state of , without regard to its conflict of laws principles.

Entire Agreement
