What a Trustee Lease Agreement Is and When it’s Used

A Trustee Lease Agreement is a contract where a trustee, acting under a trust instrument, leases trust-owned real property to a tenant. The agreement identifies the trust and trustee, describes the leased premises, sets the lease term and rent, and allocates responsibilities such as maintenance, insurance, and tax obligations. It clarifies that the trustee is acting in a fiduciary capacity and often requires trustee authority language or a trustee certificate. These leases are used when real property is owned by a trust and the trustee has power to manage or lease trust assets.

Why a Proper Trustee Lease Agreement Matters

A clear Trustee Lease Agreement protects beneficiaries, establishes enforceable tenant obligations, documents trustee authority, and reduces disputes over possession, rent, and repairs under state trust and property law.

Why a Proper Trustee Lease Agreement Matters

Who Typically Prepares and Signs These Leases

Common parties involved include trustees, beneficiaries, property managers, and prospective tenants; outside counsel and title agents may also participate.

  • Trustees and trust administrators managing real property on behalf of beneficiaries.
  • Property managers and leasing agents engaged to market and administer trust-owned rentals.
  • Tenants or lessees entering into possession under the trustee’s authority.

Use the trust instrument and consult counsel to verify trustee authority before execution to avoid later challenges.

Key Signer Roles
