Code Ann. (1972) as amended files this Motion to Compel Obedience of Subpoena and for cause would show the following facts to-wit: I. Plaintiff, , is duly elected and acting Attorney General of the State of Mississippi, and brings this action pursuant to the provisions of Section 75-24-17, et. seq. in his/her official capacity as Attorney General of the State of Mississippi. Pursuant to the Mississippi Consumer Protection Act of 1994, specifically Section 75-24-17, venue is proper in the Chancery Court of County, Mississippi and this court has jurisdiction of this matter. IV. In accordance with the authority set forth in Section 75-24-27 a subpoena duces tecum (see Exhibit ) was issued by the office of Consumer Protection of the Attorney General's Office on , . Said subpoena requested a response to a letter of request dated , (see Exhibit ) for a case opened by the Attorney General's Office in of . V. Plaintiff, through counsel, made several attempts to obtain a response to the aforementioned letter of request. However, counsel for Defendant advised that he/she questioned the jurisdiction of this office with regards to the instant controversy. VI. Through on investigation it was determined that Defendant does not have a privilege license to conduct business in County as required by Section 21-17-9, Miss. Code Ann. (1972) as amended.
