Payer further acknowledges that any incomplete or inaccurate information may delay payment and that Processing Agent is not liable for delays or penalties assessed by the utility provider where such delay is caused by incorrect data furnished by Payer.

Payment Terms and Fees

Processing Agent will attempt to remit payment to the utility provider(s) on or before the stated due date indicated on this form. Payer remains responsible for all charges, penalties, interest, or service interruptions imposed by the utility provider for late or missed payments resulting from inaccurate or incomplete instructions provided by Payer. A returned ACH or a returned check will incur a returned-item fee equal to the greater of the actual bank fee or fifty dollars ($50). If a payment requires special handling or expedited remittance, additional fees may apply and will be disclosed prior to processing.

Payer acknowledges that Processing Agent is not a utility provider and does not control the policies, billing practices, or dispute resolution procedures of the utility provider. Processing Agent's liability for any error, omission, or failure to act shall be limited to correction of the error and, if applicable, reimbursement of fees paid to Processing Agent directly related to the erroneous transaction; Processing Agent shall not be liable for consequential or incidental damages.

By signing below, Payer certifies under penalty of perjury that the information provided on this form is true, complete, and accurate to the best of Payer's knowledge. Payer authorizes Processing Agent to initiate debit entries to the bank account or charge card provided and to take any actions reasonably necessary to complete the authorized payment transactions. This authorization remains in effect until Processing Agent receives written revocation at the address provided to Payer and has had a reasonable opportunity to act upon it. Revocation does not affect payments already initiated prior to receipt and reasonable processing of the revocation.
