What the Utility Services Addendum Is and when it applies

A Utility Services Addendum is an attachment to a primary agreement that documents responsibilities, billing arrangements, meter access, allocation of utility charges, and service starts or stops for one or more utility accounts. It clarifies which party pays for electricity, water, gas, sewage, and trash, how meters are read or shared, and who arranges service transfers. The addendum is commonly used with leases, purchase contracts, property management agreements, and construction contracts to avoid disputes about recurring utility costs and operational access.

Why adding a Utility Services Addendum reduces ambiguity

A clear addendum prevents billing disputes, allocates obligations for connection, interruption, and meter reading, and documents who must notify utilities of changes. It preserves evidence of agreed allocation methods, which helps enforce billing adjustments and supports consistent accounting treatment and regulatory compliance.

Why adding a Utility Services Addendum reduces ambiguity

Who typically prepares and signs a Utility Services Addendum

Multiple parties use this addendum to assign utility responsibilities and reduce operational risk.

  • Property managers allocating tenant utility charges and recovery across units or common areas.
  • Landlords and tenants documenting whether utilities are billed directly or recovered via reimbursement.
  • Contractors and owners defining temporary service arrangements during construction or testing phases.

Use the addendum whenever utilities are separable from core contract pricing or when billing needs formal allocation.

Common preparation errors to avoid

  • Failing to list exact account numbers or provider names, which delays transfers and can misroute charges to unrelated accounts.
  • Using vague allocation language such as 'reasonable portion' without a calculation method, creating ambiguity in periodic reconciliations.
  • Not specifying the effective date or billing cycle alignment, resulting in overlapping charges or double billing during transfers.
  • Omitting signature authority details for corporate parties, which risks later invalidation if the signer lacked execution authority.

Real-world examples of addendum use

Two representative examples show how parties use an addendum to resolve specific operational needs.

Martin Properties — Lease allocation

A property manager used an addendum to allocate utilities by square footage for a mixed-use asset

  • Resulted in clearer monthly reconciliations and fewer tenant disputes
  • The documented formula and meter mapping reduced billing queries and improved tenant accounting accuracy over successive quarters.

BIS — Construction services

A contractor attached a temporary-service addendum during site build-out

  • Defined reconnection and deposit responsibilities
  • This prevented cost overruns and made final account transfers straightforward at project closeout.
