VEHICLE REMOVAL REQUEST AND SERVICE AGREEMENT

WHEREAS, Requestor is the registered owner or authorized agent of the vehicle described below and requests removal, transport, and/or disposal services; and

WHEREAS, Service Provider is duly licensed and equipped to perform towing, removal, storage, and lawful disposal of vehicles and agrees to perform such services on the terms set forth herein; and

WHEREAS, the parties enter into this Vehicle Removal Request and Service Agreement to set forth the scope, compensation, and conditions of removal and disposition.

Service Provider shall perform removal, towing, transport, temporary storage, and final disposition as necessary. Specific required services and any special instructions must be described below.

Authorization for Removal

Requestor authorizes Service Provider to remove the vehicle described above for the reason(s) indicated below and to take all reasonable actions necessary to accomplish removal, including entry to the location specified if lawful:

Payment Terms

Compensation for services performed under this Agreement shall be as follows:

Service Provider may withhold vehicle release and may apply storage and lien procedures permitted by law for unpaid charges. Requestor acknowledges responsibility for all reasonable costs of removal, storage, and disposition.

Term and Termination

This Agreement commences on the date indicated below and continues until completion of the services described in the Scope of Work or until earlier termination as provided herein.

Either party may terminate for material breach if the breaching party fails to cure within the notice period above. Termination does not relieve Requestor of obligation to pay for services performed through termination date.

Confidentiality

Each party shall maintain in confidence all non-public information disclosed in connection with this Agreement and shall not disclose such information except to its employees, contractors, or advisors who have a need to know and who are bound by confidentiality obligations. Confidential information does not include information that is publicly available or independently developed without use of the other party's confidential information.

Indemnification and Liability

Requestor shall indemnify, defend, and hold harmless Service Provider and its agents from all claims, losses, liabilities, expenses, and damages arising from Requestor's representations, ownership of the vehicle, or failure to disclose material facts. Service Provider shall be liable only for direct damages resulting from its gross negligence or willful misconduct and shall not be liable for consequential, incidental, or punitive damages.

Disposition and Lien Rights

If charges remain unpaid for the period required by applicable law or as agreed, Service Provider may exercise statutory lien rights, place the vehicle in storage, and pursue disposition or sale in accordance with law. Requestor authorizes release of possession for removal and disposition consistent with this Agreement.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the state of without regard to its conflict of laws principles.

Entire Agreement

This Agreement constitutes the entire understanding between the parties regarding the subject matter and supersedes all prior negotiations, understandings, and agreements. Any amendment must be in writing and signed by both parties.

Acknowledgements

Requestor certifies that the information provided is true and that Requestor has authority to request removal or is the lawful owner or authorized agent. Requestor further acknowledges receipt of copies of any written estimates or notices required by law prior to removal, if applicable.
