What a Vehicle Shipping Agreement Covers

A Vehicle Shipping Agreement is a written contract that sets out the rights, responsibilities, and logistics between a vehicle owner (or consignor) and a carrier or broker. Typical sections describe the vehicle (VIN, make, model), pickup and delivery dates and locations, inspection and condition reports, pricing and payment terms, insurance and liability limits, damage claims procedures, and dispute resolution. For interstate transactions, electronic signatures executed under the ESIGN Act (15 U.S.C. ch. 96) and state UETA frameworks generally support enforceability when intent, consent, attribution, and retention are documented.

Why a Clear Agreement Matters for Vehicle Transport

A precise agreement reduces disputes, clarifies who bears loss or delay risk, and documents inspection results and payment obligations. Properly executed electronic signatures and an audit trail strengthen enforceability under ESIGN (15 U.S.C. ch. 96) and state UETA rules, while compliant platforms support secure record retention and authentication.

Why a Clear Agreement Matters for Vehicle Transport

Who Typically Uses a Vehicle Shipping Agreement

The Vehicle Shipping Agreement is used by owners, dealers, brokers, carriers, and auction houses to document transport terms and risk allocation.

  • Vehicle owners and private sellers arranging transport to buyers or storage facilities.
  • Auto dealerships and wholesalers shipping inventory between lots and to customers.
  • Transport brokers and carriers arranging pickup, transit, and delivery logistics.

Each party should confirm authority to sign and include any required power of attorney or title documentation before shipment.

Essential Sections to Include in a Professional Agreement

A robust Vehicle Shipping Agreement groups core obligations so each party’s duties are clear and claims can be resolved efficiently.

Parties & Vehicle

Identify consignor, consignee, and carrier; include full legal names, contact details, VIN, year, make, model, and odometer reading for precise identification and title checks.

Pickup / Delivery

Specify exact pickup and delivery addresses, time windows, appointment requirements, and procedures for missed or rescheduled pickups to avoid ambiguity and extra charges.

Condition Report

Include a pre-shipment inspection and an itemized condition report or damage checklist; attach photos or electronic inspection forms as exhibits.

Pricing & Payment

Detail total charges, payment timing, deposits, acceptable payment methods, and consequences for nonpayment or disputed charges.

Insurance & Liability

State carrier liability limits, required insurance certificates, and whether supplemental cargo or transit insurance is included or must be purchased separately.

Dispute Resolution

Specify governing law, venue, claims process and timelines, and whether arbitration or small-claims procedures apply to reduce litigation uncertainty.

Common Timelines and Processing Expectations

Track key dates from agreement execution through delivery and claims deadlines to protect rights and comply with carrier rules.

Execution Date:

Date contract becomes effective upon final signature

Pickup Window:

Carrier confirms pickup date and appointment window

Delivery Window:

Expected transit window or agreed delivery date

Damage Claims:

Timelines vary; commonly 7–30 days per carrier policy

Record Retention:

Keep executed agreement and audit trail per retention policy

Common Mistakes to Avoid

  • Using informal descriptions instead of full VIN and odometer readings leads to identification disputes and claim denials.
  • Failing to attach inspection photos or a signed condition report weakens damage claims and creates evidentiary gaps.
  • Omitting insurance limits or relying on verbal quotes can expose owners to uncovered loss or unexpected out-of-pocket costs.
  • Not confirming signer authority or missing a required power of attorney can invalidate carrier pickup or title transfer actions.

Risks and Potential Consequences of Errors

Delayed Delivery: Missed appointments and rescheduling fees
Denied Claims: Insufficient inspection evidence rejects payouts
Insurance Gaps: Liability outside stated policy limits
Title Issues: Incorrect owner details impede registration
Payment Disputes: Chargebacks or double-billing risk
Legal Exposure: Breach claims and contract litigation

Supporting Documents to Include with the Agreement

Attach these documents to strengthen inspections, insurance claims, and title transfer procedures.

Condition Report

A signed, itemized condition report with photos documents pre-shipment vehicle condition and supports any damage claim with dated evidence.

Bill of Lading

The bill of lading records carriage terms and acts as proof of delivery and receipt for the carrier and consignee.

Insurance Certificate

Carrier or owner insurance certificates verify coverage limits and policy numbers required for claims processing.

Title / POA

Attach title transfer documents or notarized power of attorney when the owner cannot sign in person to prevent registration issues.

Who Is Authorized to Sign the Agreement

Owner / Title Holder

The vehicle owner listed on the title or the registered owner must sign or grant a notarized power of attorney for another person to act on their behalf; signer identity should match title records.

Authorized Agent

A broker or carrier representative may sign if they have written, notarized authorization or a valid power of attorney that specifically grants shipment and release authority.
