Driver represents that he/she is at least 21 years old, holds a valid driver's license, and is not under any restriction that prohibits test driving. Driver authorization to run driving record: (initials)

Scope of Work

The Dealership will permit the Driver to operate the designated vehicle solely for the purposes and route described above and only under the supervision and constraints set forth herein. The Driver shall not use the vehicle for any commercial purpose, towing, off-road activity, racing, or any unlawful purpose.

Late fee and chargeable damages: If any required payment or deductible is not paid when due, a late fee of may be applied. The Dealership may retain part or all of the deposit for unpaid charges, towing, repairs, diminished value, cleaning, or other expenses reasonably related to damage or misuse during the test drive.

The Dealership may terminate immediate test drive privileges for any unsafe operation, violation of law, intoxication, or breach of these terms. Upon termination, the Driver must immediately return the vehicle and keys to the Dealership.

Confidentiality

The Driver shall not disclose any trade secrets, technical data, or proprietary features of the vehicle that the Dealership designates as confidential. The Driver will treat any proprietary demonstration materials, keys, or access devices with care and will return them upon demand. Confidential information does not include information that becomes publicly available without breach of this agreement.

Release, Indemnity and Acknowledgment

The Driver acknowledges and agrees that operating a motor vehicle carries inherent risks. The Driver releases and holds harmless the Dealership, its officers, agents, and employees from claims arising from normal wear and tear or loss, except to the extent caused by the Dealership's gross negligence or willful misconduct. The Driver agrees to indemnify and defend the Dealership for loss, damage, liability, or expense arising from the Driver's negligent, unlawful, or unauthorized use of the vehicle during the test drive.

The Driver certifies that he/she will comply with all traffic laws, will not operate the vehicle while under the influence of alcohol or drugs, and will exercise reasonable care. The Driver consents to pay for damage resulting from misuse, neglect, or failure to follow the Dealership's instructions.

Governing Law; Entire Agreement

This agreement is governed by the laws of the State of without regard to conflict of law principles. Any dispute arising out of this agreement shall be subject to the exclusive jurisdiction of the courts in the county where the Dealership is located.

This instrument constitutes the entire agreement between the Dealership and the Driver with respect to the subject matter hereof and supersedes all prior representations, understandings, and agreements, whether written or oral.
