What the Veterinary Medicine Agreement Covers

A Veterinary Medicine Agreement is a written contract that documents the relationship between an animal owner and a veterinary practice or clinician. It specifies the scope of clinical services, treatment authorizations (including anesthesia and emergency care), fee schedules and payment terms, consent for diagnostic procedures, and who may make medical decisions for the animal. The agreement also addresses recordkeeping, release of medical information, limitations of liability, and conditions for euthanasia when applicable. Electronic execution under U.S. e‑signature law is generally accepted when the parties consent in a manner compliant with ESIGN and applicable state law.

Why a Clear Agreement Benefits Both Parties

A well-drafted Veterinary Medicine Agreement reduces misunderstandings about treatment, clarifies payment expectations, protects professional and client interests, and creates an auditable record of consent and instructions. It facilitates timely care, supports insurance and claims processing, and helps manage risk by documenting client decisions for high‑risk procedures.

Why a Clear Agreement Benefits Both Parties

Who Typically Completes a Veterinary Medicine Agreement

The agreement is completed whenever a veterinary practice needs documented consent, fee authorization, or service terms tied to an animal's care.

  • Veterinary clinics and hospitals completing intake and consent for clinical services and surgeries.
  • Pet owners or authorized agents signing on behalf of the animal and agreeing to payment terms.
  • Specialists, referral practices, and boarding facilities documenting transfer-of-care instructions and liability allocations.

Each party should retain a signed copy; the practice typically keeps the original in the medical record while clients receive a copy for their records.

Essential Clauses to Include

A professional Veterinary Medicine Agreement balances clinical detail with clear administrative terms so both clinical staff and owners understand rights, responsibilities, and remedies.

Scope of Services

Describe procedures offered, diagnostics, and any excluded services. Be specific about routine care versus specialized or referral procedures to avoid ambiguity and mistaken expectations.

Consent & Authorization

Obtain explicit informed consent for anesthesia, surgery, and sedation. Explain risks, alternatives, and any authorization for emergency treatment if the owner is unreachable.

Fees and Payment

State fee schedules, deposits, accepted payment methods, and consequences for nonpayment such as treatment suspension or lien rights where permitted by law.

Emergency Care

Define what constitutes an emergency, who may authorize emergency treatment, and whether the practice will proceed when immediate consent cannot be obtained.

Records & Privacy

Specify who may access medical records, methods for sharing records with insurers or referral providers, and how long records will be retained.

Limitations of Liability

Include disclaimers, indemnity provisions, and dispute resolution processes, ensuring clauses comply with state consumer protection and veterinary practice statutes.

  • Failing to obtain explicit consent for anesthesia or euthanasia procedures, which can lead to complaints and liability claims.
  • Omitting payment terms or deposit requirements, resulting in unpaid balances and collection actions.
  • Not recording delegated decision authority for agents, leaving staff uncertain during emergencies and delaying treatment.

Risks and Potential Consequences

Malpractice Claim: Civil liability risk
Unpaid Fees: Financial loss and collections
Regulatory Action: Board complaints or fines
Insurance Denial: Claim rejection risk
Client Dispute: Reputational harm
Record Loss: Evidence unavailable in disputes

Real-World Use Cases

Two brief scenarios show how a Veterinary Medicine Agreement is used in practice to document consent and speed administrative tasks.

Routine Surgery Consent

A clinic sends a preoperative consent form to the owner before surgery via secure eSign

  • The owner reviews risks and signs on a mobile device
  • The signed agreement is attached to the patient chart, speeding check‑in and reducing day‑of administrative delays while preserving consent evidence.

Emergency Authorization

An owner authorizes emergency treatment remotely after an urgent call

  • Clinic documents the verbal consent and sends an electronic form for signature
  • The executed agreement confirms the scope of emergency care and documents payment authorization for insurer submission.
